COM:FOP Germany suggests that images of this recent statue are not free. /Pieter Kuiper (talk) 13:56, 22 September 2009 (UTC)[reply]

Where do you see that suggestion? This is a permanent installation in a public place. I'd say that is easily covered by german FOP. --Dschwen (talk) 14:53, 22 September 2009 (UTC)[reply]
It is not on a public road. It is even "inside", under a roof. /Pieter Kuiper (talk) 14:57, 22 September 2009 (UTC)[reply]
Actually it is not under a roof :-). And the Neue Wache is a public place. Does it matter that it is not a road? --Dschwen (talk) 15:03, 22 September 2009 (UTC)[reply]
Ah well, under a hole in the roof... I looked at this law exam problem, and there it says that even university grounds are not necessarily public places. /Pieter Kuiper (talk) 15:09, 22 September 2009 (UTC)[reply]
Mh, yeah. It certainly is not a clear cut case. It is a federal memorial though and as such intended for the entire public (as opposed to a university). In any case IANAL :-). --Dschwen (talk) 15:11, 22 September 2009 (UTC)[reply]
FYI, I asked at de:Wikipedia:Urheberrechtsfragen. And the first reply mentions an analogy to cemeteries which are also considered public places. Let's see what results that discussion brings. --Dschwen (talk) 15:23, 22 September 2009 (UTC)[reply]
By the way, I read your link, and you are interpreting a little too much into that. The gist is: kommt es darauf an, ob sie für den öffentlichen Verkehr freigegeben sind. That is the case with the Neue Wache. --Dschwen (talk) 15:59, 22 September 2009 (UTC)[reply]
I will follow the discussion on dewp. What is "Verkehr"? Wider than "traffic"? Is the Neue Wache more public than a church? Less public than a subway station? I do not know, but this just seemed questionable. /Pieter Kuiper (talk) 16:13, 22 September 2009 (UTC)[reply]
