onate as a speaker, henever failed to exert a wonderful effect upon the jury; and for thefirst time in the history of the court, a distinguished attorney for thedefense in a certain case based a motion for a new trial on the groundof the undue influence of Col. Lees passionate eloquence upon thejury. He was the most severe prosecutor that the Circuit Court has everhad, and perhaps did more to enforce the law and mete out justice tocriminals than any man who ever held the position. It is said thatwhile he was prosecuting there was not a single verdict of acquittal onthe charge of homicide. He was a constant and hard worker, and, by close application tohis profession and laborious efforts as prosecuting attorney, he brokedown his constitution. For nearly two years he has been unable toappear at his place in court, and for more than a year was so wastedby disease as to be little more than a walking skeleton. He breathedhis last, surrounded by his family and a number of devoted friends. I

The Trabues of Kentucky are descended from an old Virginia stock,and, from the earliest known history of the country, have been of themost decidedly martial disposition—engaging in the Indian wars inVirginia, 1755-60; in the Revolutionary War; in the border troublesof Kentucky, Indiana, and Illinois; and lastly, in the heroic struggle ofthe South. When the late war broke out there were of the name, andrelated to Col. R. P. Trabue, in the States of Kentucky, Missouri, Illi-nois, Tennessee, and Mississippi, thirty-five able-bodied men, fit to beararms, of whom thirty-two united their fortunes with the Army of theConfederate States. In November, 1777, James and Daniel, two younger brothers ofWilliam Trabue, (who served during the Revolution as an officer ofthe Virginia line, and from whom descended the late Hon. GeorgeAlfred Caldwell, of Louisville,) enlisted in Caroline County, Virginia,under Gen. George Roge
