I'm a little perplexed as to why this file should be deleted. The file is from Flickr where it is licensed under the Attribution 2.0 Generic Creative Commons license. According to the Upload page files with this license are allowed. The file is identical to the one on Flickr so I can't understand how it is derivative work. Sorry, I should have been more clear. It's a derivative work (see specifically this section) of the sculpture of E.T., which in turn is a (licensed) derivative of the character/movie itself, and there's no FOP in the U.S. for anything but buildings.
