hem, and that the same are free from all liensand attachments, and until such evidence to the satisfaction of the En-gineer is furnished, and until ties from time to time are actually acceptedand marked by the Engineer, the same shall be at the risk of the Contractor.Cash payments equal to about ninety per cent, of the value of the ties sodeliveied and accepted to be made to the Contractor monthly on the writtencertificate of the Engineer that such ties have been so delivered and accept-ed, and such evidence furnished as aforesa-id, and the said certificate shallbe a condition precedent ir> the right of the Contractor to be paid the saidninety per cent, or any part therefor.
