Once a Protestant Conservative MP, he became a supporter of Catholic emancipation and joined the Repeal Association in 1843, became a leading member of the Young Irelanders and with Gavan Duffy and others founded the Irish Confederation in 1847. At the end of July 1848 a small group under O' Brien clashed with forty-six policemen at Ballingarry, Co. Tipperary. After exile in Tasmania he was given a full pardon.
