Rispondo ad entrambi. Il concetto è in realtà più semplice di quanto sembri. Ogni "opera dell'ingegno" è protetta (copyrighted) da un monopolio di sfruttamento concesso in automatico al suo creatore (che ovviamente può cederlo a pagamanto, o anche gratis, come facciamo noi su WikiCommons). Questo monopolio dura per tutta la vita e fino a 70 anni dopo la sua morte.

• Nel caso di una statua abbiamo due diversi diritti d'autore:
  • Quello di chi ha scolpito la statua.
  • Quello di chi ha fatto la foto. In realtà anche le nostre foto che carichiamo noi su Commons sono copyrighted (da noi) ma concesse in uso gratuitamente eccetera (dipende dalla licenza che avete scelto).
• Nel caso della foto di una persona i diritti sono due ma diversi:
  • Il "diritto d'immagine" della persona ritratta, con l'eccezione di persone notorie riprese nel corso delle loro attività pubbliche (esempio: cantante, uomo politico).
  • Quello di chi ha fatto la foto.

Nel nostro caso avevamo il permesso di chi ha scattato la foto, ma non di chi ha scolpito la statua, o dell'architetto dell'edificio (che non è morto da almeno 70 anni). Da qui la richiesta di cancellazione.

Alcune nazioni concedono un permesso automatico di riproduzione per tutte le opere esposte al pubblico in modo permanente. Si chiama "diritto di panorama". In Italia però, purtroppo, questo diritto non esiste. Ahimè. la sola strada che abbiamo in Italia, e non ho dubbi sul fatto che in futuro lo faremo (anche se ora è troppo presto, abbiamo ancora troppe cose da caricare) sarà contattare gli artisti o le fondazioni dei loro eredi e chiedere il permesso di riproduzione. Sono certo che molti diranno di sì: dopo tutto, è pubblicità gratis per loro. Se nel vs caso ve la sentite di contattare l'artista o i suoi eredi per chiedere il permesso di pubblicazione, la cosa è non solo fattibile ma addirittura da incoraggiare.
