File deletions and notifications

Could you please restore File:Central Downtown Astana 2.jpg for possible local upload to en-voy. As you may know, the bot that has been notifying projects of relevant deletion requests hasn't been working for some time. When it worked, we could make the decision on replacement, local upload or just removing the image while the discussion was ongoing. You had written on my undeletion request w.r.t Dr Jaime Rangel, I mentioned that the picture was taken by an employee of his, for his publishing house on a book printed by his publishing house and authored by him and published by him. He was the sole owner, and all this was prior to the Indian copyright Act of 1957, which only applied in Goa from 1961.
Request if you can help me on how to articulate this, or provide the appropriate documentation, as there was no mechanism in rural India for such registrations and the publisher/author owned the material that he put out. Now legally, I am 110% sure that in India, there will be no copyright trouble. How would you suggest I put that across to the editors.

First, unless the employee who took the photograph had an explicit written work for hire agreement, the copyright belongs to the employee or his heirs. Second, you say "an employee of his". If the employee worked for the publishing house and in fact had a written work for hire agreement, then the publishing house, not your father, owned the copyright. If the publishing house still exists, then it must give a free license. If it does not still exist, then unless it explicitly licensed the image to your father in writing, the image belongs to whoever owns the intellectual property of the publishing house. The only case in which you, as your father's heir, could license the photograph as required here would be if the employee actually worked for your father, not the publishing house, and had executed a written work for hire agreement giving your father the rights to his work. Since it is unlikely that you will be able to produce the agreement, it seems unlikely that the image can be restored. .     Jim . . . Hello Jim,

(Sorry french) Bonjour,

Vous avez lancé une page de suppression pour le fichier File:Drago 2019 Vive Latino (cropped).jpg. Pour information, ce fichier vient d'une image que j'ai importé et je n'en ai pas été notifié (après sachez que c'est pas grave et je ne vais pas en chier une pendule comme on dit en France). C'est plus important si ce débat aboutit à la suppression (et encore faut-il qu'il se termine un jour) que l'on supprime aussi le fichier mère.

Enfin je n'ai pas envie de donner de quelconque argument sur cette page de suppression car je n'ai toujours pas compris (et je ne comprendrais probablement jamais) le comment du pourquoi et les exceptions au droit d'auteurs.

The law and the formal position of the US Copyright Office is perfectly clear that masks have copyrights. The USCO distinguishes masks form the rest of the costume on the grounds that clothing, even clothing that is part of an elaborate costume such as the one in the image you cite, is utilitarian and cannot have a copyright. Masks, on the other hand, do not serve a utilitarian purpose and there fore can, if creative, have a copyright. The images in the Deletion Request infringe on the copyrights for the masks and cannot be kept on Commons without written permission from the makers of the masks. .     Jim . . . I don't know what more you want. The whole discussion is out of place -- UnDR is not the place to discuss policy and the whole request was unnecessary in the first place. As I said, an empty category can be reopened at any time there is a file to go in it by any editor -- no UnDR is needed. .     Jim . . . A policy based reason for the request was given. I miss an explanation of you on how your closure relates to that.
