Thanks for your reply. The photographer or the photographer's estate retains all copyright, up until 95 years after his death. The fact that he distributed copies of his work for free to the local students, without explicit copyright claims, does not void his copyright, unless the work was published before 1978 with mention to the creator, but no mention of copyright. Otherwise he, or his estate, would have to explicitly release the material to the public domain for your PD license to stand. Sorry for the late reply, but I've been very busy these days. First of all I'd really prefer if you contacted me through my talk page, not my email, since our discussion is of interest to the community in general, not just us two. Now, regarding the image, I'm not sure what happens when no relatives or estate of the photographer exist, you should ask at Commons talk:Licensing. The Arizona Historical Society license as you mention it, explicitly excludes commercial use and is therefore incompatible with Commons licenses. You would indeed have to request that they provide a less restrictive license. Be aware though that it might be worth the trouble, especially since various other archives and libraries have released similar photos to the Flickr Commons under a "no known copyright" license. --Ferengi (talk) 07:21, 22 October 2009 (UTC)
