Braniff PD court case

You mention "all Braniff Airways photos, files and likenesses are part of public domain as a result of a March 2011 court order that remanded these to the public domain Mmb777e (talk) 01:50, 23 February 2014 (UTC)" in the description of a photograph, there are a few court cases in 2011 concerning Braniff (mainly for precedent etc). Are you able to link to the court case or provide additional information to allow us to find it ? We think it may (depending on the context) allow material owned at one point by other airlines, such as Pan Am and TWA to also be released into the public domain, but would like to verify this. Hello Yes absolutely. And let me state that it was a court ordered agreement between the Trademark Court and the owner of Braniff's Trademark. Braniff's Trademark was owned by a company that buys and sells old dormant Trademarks. Once the third Braniff, Braniff International Airlines, Inc., ceased operations in 1992, then the Trademark was sold to a brand company such as the one that attempted to see it in 2009. When the sale of the Trademark did not occur, an agreement was formed that made the Trademark dormant. A current case by New York company wanting to use Braniff's Trademark is being heard at this time. It is doubtful they will be able to obtain the Mark. In the case of both TWA and Pan Am, those Marks, likenesses, copyrights, etc., are all owned by private entities. TWA by American Airlines and Pan Am by railroad company in Pennsylvania. Now if those companies did not retain the rights to their company photos, etc., but instead allowed them to remain with their artists, then you might be able to contact the artist or their estate to see if the rights could be purchased or made available to the public domain otherwise you would need to contact the owners of those likenesses. Now this is where Braniff was different. They retained ALL rights to their photos or any works associated with them including Alexander Calder, Emilio Pucci, Halston, and Alexander Girard. All rights to those Marks, copyrights, etc. ie intellectual property were retained by Braniff. Even the Calder Foundation admits that they have no control over the Braniff materials. A huge amount of Braniff's materials were auctioned at several bankruptcy auctions at DFW Airport in 1983 and that is where I purchased a great number of photos along with full rights to them from Braniff's Public Relations and Advertising Department. Prior to Braniff Airways cessation of operations in May 1982, the entire Public Relations Archive was remanded to the University of Texas at Dallas. UTD and my organization own the largest number of historic Braniff photos along with their full rights. Any Braniff photos not owned by someone that purchased them directly from Braniff would be considered public domain as their is no longer any Braniff entity and therefore no owner of the Trademarks, copyrights, likenesses, etc. You can search Braniff Trademark and find the information on that part of the equation that you are looking.
