I was under the impression that a photograph of a screen showing a copyrighted image did not qualify as a derivative work, and instead was blatant enough to go through a speedy deletion without much comment. Hi Fanboyphilosopher!

I uploaded this file to Wikiversity under Fair use but was concerned about the screen in front of the image so I sent an email to Dr. Ashley Poust. Here is what I wrote:

"I recently uploaded this image File:Wulong bohaiensis1.jpg under Fair use but I have some concerns about the origin of the image that I hope you can help with.

The image was obtained by someone else and uploaded to our Commons website. The image appears on a website entitled, "File:Wulong bohaiensis.jpg" at https://commons.wikimedia.org/wiki/File:Wulong_bohaiensis.jpg.

The source is https://eurekalert.org/multimedia/pub/221711.php?from=452776 which is the American Association for the Advancement of Science and states "USAGE RESTRICTIONS None". But under Terms & Conditions states: "You may not reprint, reproduce, republish, or otherwise distribute content that appears on EurekAlert! in any way except for your own personal, non-commercial use, without permission from EurekAlert! and AAAS." and includes "all submissions must include an explanatory caption, as well as preferred credit line and information on terms of usage or permission requirements, if any."

This is not the image shown at "San Diego Natural History Museum paleontologist describes a dinosaur that is new to science, offers view into dinosaur-bird evolution" from SDNHM."

May I have permission to use the image here or one without the apparent screen visible, if available. It's currently in a draft lecture "Draft:Paleontology""

Here's his response:

"You're welcome to use the image: just please attribute it to "Ashley Poust". I took the photo and Eurekalert is using it with permission, so I believe that's just pro forma in this case.

I've attached a version in case that helps.

His email is at the San Diego Natural History Museum so there's no problem for me to pass it on to whomever or OTRS if needed. The usage restriction for EurekAlert! States: "None". So what would you like to do? --Marshallsumter (talk) 22:15, 21 January 2020 (UTC)[reply]

Eurekalert is simply a science news propagator, so it does not own the copyright to images it hosts. And even if it did, that wouldn't be sufficient since Wikipedia images are made available to the public under a commercial license and would not pass their "personal, non-commercial use" clause. It sounds like Ashley Poust is the copyright owner and that they are giving you permission, but I'm not sure. If not, you would have to get direct approval from the journal in which it was first published (online version here[1]), and I doubt the journal would allow that. Since Eurekalert did not provide the image under a free noncommercial license, you need to get approval directly from the copyright owner. You should respond to Ashley, asking whether they are the copyright owner and would be fine with the image being published under one of Wikipedia's creative commons image licenses. These include CCBY-SA 4.0, CCBY-SA 3.0, CCBY 4.0, or CCBY 3.0. If Ashley clearly says yes, I'll consider you off the hook and you'll need to take a few more steps to formalize the permission you received. Actually, I need only pass on Ashley Poust's email. I already have the image on Wikiversity without the screen and permission to use that clean image. If you would like to endeavor to keep the image or have the one without the screen (same image but not controlled by AAAS or Eurekalert) but by Ashley Poust I can upload it here, but the rest is up to you or others here at commons. --Marshallsumter (talk) 03:19, 22 January 2020 (UTC)[reply]

Hello,

I am a summer student at Community Museums Association of PEI located in PEI, Canada https://museumspei.ca/ I am making educational social media posts for our facebook

I was wondering if I can use your diagram of erpetonyx arsenaultorum in my post? I would credit you of course - if so what credit should I use?.
