Thanks for uploading File:Colin Francis MacKinnon.jpg. I notice that the file page either doesn't contain enough information about the license or it contains contradictory information about the license, so the copyright status is unclear.

If you created this file yourself, then you must provide a valid copyright tag. For example, you can tag it with {{self|GFDL|cc-by-sa-all}} to release it under the multi-license GFDL plus Creative Commons Attribution-ShareAlike All-version license or you can tag it with {{PD-self}} to release it into the public domain. (See Commons:Copyright tags for the full list of license tags that you can use.)

If you did not create the file yourself or if it is a derivative of another work that is possibly subject to copyright protection, then you must specify where you found it (e.g. usually a link to the web page where you got it), you must provide proof that it has a license that is acceptable for Commons (e.g. usually a link to the terms of use for content from that page), and you must add an appropriate license tag. If you did not create the file yourself and the specific source and license information is not available on the web, you must obtain permission through the VRT system and follow the procedure described there.

Note that any unsourced or improperly licensed files will be deleted one week after they have been marked as lacking proper information, as described in criteria for deletion. If you have uploaded other files, please confirm that you have provided the proper information for those files, too. If you have any questions about licenses please ask at Commons:Village pump/Copyright or see our help pages. Thank you.

No required license templates were detected at this file page. Please correct it, or if you have any questions please check my FAQ or contact me on my talk page. Yours sincerely, Jarekt (talk) 12:27, 28 October 2014 (UTC)[reply]

Hello Wayne V Johnson, the following content you uploaded violates one or more of our policies and therefore has been or will soon be deleted:

File:Colin Francis MacKinnon.jpg

The Wikimedia Commons (this website) only hosts media files with a realistic educational purpose and that can be used for any purpose, including:
  • use in any work, regardless of content
  • creation of derivative works
  • commercial use
  • free distribution

See Commons:Licensing for the copyright policy on Wikimedia Commons, and Commons:Image casebook for some specific examples. Some other Wikimedia projects have different licensing policies. For example, the English Wikipedia allows fair use of sounds and photographs. This is not the case on Wikimedia Commons; "fair use" materials are not acceptable here.

Please make sure that you only upload educational content you have created yourself, those which are out of copyright, or those for which you have the required permission for the work to be used in all the ways described above. Please note that derivative works of copyrighted material are also considered copyrighted. Again, please read through Commons:Licensing, which is quite crucial, to understanding how Wikimedia Commons works. Thanks for your contribution, and please do leave me a message if you have further questions.

Yours sincerely, Green Giant (talk) 01:13, 4 November 2014 (UT

Green Giant,

In accordance to the rules, the photo of Colin Francis MacKinnon has no copy rights attached to it as I checked. Since he is my 3rd uncle, I doubt VERY much anyone would mind if I include a photo of him on his page even if there were a copy right. The photo is well over 100 years old, if not older. — Preceding unsigned comment added by Wayne V Johnson (talk • contribs) 03:38, 4 November 2014‎ (UTC)[reply]

We take copyright very seriously, even if copyright holders don't care. The onus is on you the uploader to demonstrate why an image should be hosted on Wikimedia. Since you failed to add license information, the file had to be deleted, because we don't have the time or resources to thoroughly investigate every one of the thousands of files uploaded every week. Your sarcastic comment about people jumping out of the grave was unwarranted. MacKinnon died in September 1879, so the photo cannot have been taken any later than that. We are also assuming the photo was taken in Canada but it could have been taken in Italy, given that Catholic clergy like to visit Rome and there is no evidence that he avoided travelling again despite his first journey in rough seas. Let's assume the photo was taken by a 20 year old photographer, and it is entirely possible that the photographer lived to a hundred. That means s/he might have died as late as the 1950's. If the photo is Canadian, there is no problem, but if it is Italian, then the photo may be copyright until the 2020's because the rule in Italy is 70 years after the death of the author. So it isn't as clear cut as you made out in your comment but I am going to accept it as a Canadian photo and have changed the license tag as such. I have also restored the larger original image and fixed part of the Wikipedia article. Green Giant (talk) 09:14, 4 November 2014 (UTC)[reply]
I indicated that the photo had no copyright. I indicated that the person died well over 114 year ago and before 1920. I have searched for any copyright that may have been attached to the photo. Even on the sites where his photo was present, there is no copyright. There is no known copyright attached anywhere. Because he was a religious figure, his photo is most likely one in which the Church took of him. There has never been a copy right placed on a religious figure that I am aware of unless it was a drawing or painting and even then, 99% of the time, the image is open to be shared. I don't see why you couldn't have notified me before taking the image down. I could have done a more through search. I have done such a search and I am still not able to find a copyright. As I also indicated, I am his 3rd nephew. Even if there were a copyright, I seriously doubt anyone would care. I posted his image according to the rules. You took it down. Of course, you will understand why I will not be donating anymore money to Wikipedia. — Preceding unsigned comment added by Wayne V Johnson (talk • contribs) 12:09, 4 November 2014 (UTC)[reply]
You were notified on 28 October, a week before deletion. Please scroll up and read the message above this section, left by User:Jarekt. It isn't our fault that you have apprently ignored that message. Our standard practise is to give seven days for action after notification. On the issue of copyright, please read COM:NOT#Commons_cares_about_copyright_even_when_a_copyright_owner_does_not, which should clarify our position. As for your donation or future lack of it, that is your own business. Like almost everyone else on here, I am a volunteer and I do this in my spare time, so it means little to me when people say they won't be donating again. This might surprise you but I too have donated money to Wikimedia and will continue to do so but I don't feel like using that as a bargaining tool. Green Giant (talk) 12:28, 4 November 2014 (UTC)[reply]
That is a lie and you know it. NOTHING came in my E-Mail or I would have taken care of it immediately! Am I supposed to check on Wikipedia for messages now? Why wasn't it sent to my regular E-Mail? Is this the way you conduct business? I am sorry I ever got involved with such an outfit now. Had I known that before, I would never have sent donations to your organization! You people are frauds! I have heard from countless people to never trust Wikipedia for their content but, I always stuck up for you people regardless but, if you lie about sending people notifications in their E-Mails, how am I supposed to trust the content of what is posted on your site? I have thousands of followers on my social network sites. They will be informed of this.
I just checked my E-Mail for the 28th. I checked the trash and I even checked the Spam folder. NOTHING from your organization came on that day. I can send you an photo copy but, I somehow feel that it wouldn't matter. You won't have to worry about me adding anything else on your site in the future. — Preceding unsigned comment added by Wayne V Johnson (talk • contribs) 19:15, 4 November 2014 (UTC)[reply]
Who said anything about sending you emails? Read the second message on this page or click on the history tab and note the EDIT done by Jarekt. If you want emails sent to you each time someone leaves you a message then you have to change your settings. You will need to log in to do that (you've not been logged in when replying to this message, which is why your IP is being recorded rather than your username). Once you are logged in, click on Preferences at the very top of this page and then click the Notifications tab. Then check the boxes under the "Notify me about these events" section. Green Giant (talk) 07:16, 5 November 2014 (UTC)[reply]
I had my settings set so that my E-Mail was visible. He is the one who chose not to notify me. So, the fact remains that I was not notified as you indicated.
It seems you are incapable of scrolling up and reading a message that was left on this page (your user talk page) and is still there. In case you miss it, the notification has a nice red line around it and it is located below the welcome message. Did you click on the history tab at the top and note the time stamped message left by User:Jarekt. Green Giant (talk) 15:30, 5 November 2014 (UTC)[reply]
