1970s South Station photos[edit]

You've recently uploaded a slew of 1970s images of South Station. However, many of them contain "Copyright Douglas Shoop Photography - All rights reserved" in the metadata, which does not appear to be you. Are these actually images that you took? Origin of 1970s South Station photos[edit]

Yes, I took these photos. Some of them were published in an article that I wrote in the Boston Sunday Globe on January 23, 1972. I've uploaded the article here: https://drive.google.com/file/d/0B11DuNlsU-t6bEVNYWZKbWcya1E/view?usp=sharing

Several years ago, the Mass Department of Transportation asked me if they could use some of these photos in connection with the South Station Expansion Project. For example, see the one linked at the top of this page: https://blog.mass.gov/transportation/mbta/south-station-expansion-1980s-renovation/

The images I uploaded to Wikimedia were given to me on disk by Mass DOT after they scanned my original slides and prints for their project. Evidently, the scanned images contained the incorrect copyright notice.

Now what?

Thank you, that is probably the best documentation I could possibly ask for! Now what is that I'll do a bit of categorization cleanup, and quite likely your photos will find their way into other articles as well.
I apologize if I sounded accusative. I frequently see users upload photographs where the metadata does not match their claims of having been the original photographer; the vast majority of the time, their claims are false. Your case appears to be one of the exceptions. Thank you so much for contributing your work to Wikimedia - it's incredibly difficult to find good mid-century images that are released under free use licenses. No problem.NewtonCourt (talk) 21:14, 14 January 2016 (UTC)[reply]
I've categorized them and removed the bad metadata from the color images. Pi.1415926535 (talk) 01:31, 20 January 2016 (UTC)[reply]

I've written to the artist to request her permission to use the photo.

NewtonCourt (talk) 14:14, 7 September 2019 (UTC)[reply]

Hi Newton Court. You should probably post that in the deletion review related to this file. Just for reference, the license on the photo itself (if you're the photographer) is fine; it's imagery of the actual work itself which needs permission. Photographs of 3D works of art are eligible for their own copyright since they are considered derivative works; so, the artist's permission is not needed for your photo. There is, however, no en:freedom of panorama in the United States for publicly displayed 3D works of art (see COM:FOP United States), so the COM:CONSENT of the artist to release the work itself under a free license that Commons accepts (see Commons:Licensing) is what's needed from her. That's assuming that she retained copyright over it and didn't transfer it to the park (or city operating the park) as part of some kind of en:work for hire. In that case, permission would be needed from whomever now owns the copyright over the work. -- Marchjuly (talk) 15:29, 7 September 2019 (UTC)[reply]
