Request for some supporting eyes on a ticket

Hi, I have been holding this long running ticket where the model has an interest in seeing their photograph used on Wikipedia. Evidence of permission from the magazine or photographer have been difficult, and I am going to write a reply in the next couple of days to summarize, in a polite way, why the images were deleted. I would appreciate other eyes on the history, and some comments of alternative views (or suggestions for the way to respond) as internal notes against the ticket, so that I can provide a balanced opinion back. I am the content holder, and I'm releasing this content under an appropriate license.

A week ago I was informed by a the user, DunDunDunt, he had uploaded images of photographs, that I had licensed for most situations. Usage by a commons is permitted, but nevertheless, they were deleted and the user sought my help to correct the situation. So, I tried to come in and fix it, but was instead berated by users claiming that I was pulling a "red-herring", or even "Who is Mario? Since he gives us no corporate title, we can not know that he has any authority to license the images", or that "Mario should either license a limited number of his images CC-BY-SA, without any special template, or go away.."

Two things. First off, no one can force me to license out my intellectual property under any license. Second off, I then assumed good faith and then proceeded to upload a few images for myself with the intent of those images being licensed under an acceptable existing license. But, after doing so, I was then forced to use the OTRS system in bad faith.

I license these images for CC-BY-SA, but I don't appreciate this hullabaloo one bit.

I would also appreciate if DunDunDunt's images were restored (I saw that some were even deleted without notice to that user), this whole ordeal is causing a few issues on web-crawlers around my site. And negative links to my site.

Just a small note: With all of the images of fictional characters or celebrities, on this site, there must be some type of personality notice of some sort "if an image shows an identifiable person or item, using that image for commercial purposes may infringe on someone’s rights, and separate permission should be obtained from that copyright holder." Examples; File:1968 Road Runner emblem VA.jpg, File:Johnny Cash-Nixon.jpg, and File:Voiture Pikachu avec Peluches.jpg. Otherwise there could be serious issues in the future from other copyright holders. I don't have a problem with it in general, but it would just be an important note for the future. Vitor Mazuco: As far as I am concerned, the ticket (#2014071610013051) is acceptable, given the context. The OTRS agent that handled the ticket wants additional clarification, however. While it would be nice if the copyright holder got back to us (literally all he has to say is "Yes, what you said is fine"), the files are already tagged with {{PermissionOTRS}}, so if you're worried about them being deleted over insufficient permission, don't be. The OTRS email is from "Maya Lavie-Ajayi," yet the camera metadata says "Haim Ravia. All Rights Reserved." Why are we accepting permission from someone other than the author? The ticket was processed (and the image OTRS tagged) by the uploader, which seems inappropriate. Disinterested, third party review needed. Эlcobbola talk 18:06, 4 August 2014 (UTC)[reply]

Images of Directors for the Anna Crusis Women's Choir

Hi OTRS,

Are there any tickets in the queue for the following files?

I've been working with members of the Anna Crusis Women's Choir to try to get photos of the four directors that they've had in their history, for use on the web page en:Anna Crusis Women's Choir

Two files of directors so far were submitted, and I requested the providers to send emails to permissions-commons@wikimedia.org authorizing release on commons: File:Miriam Davidson promotional photo.jpg File:Cathy Roma publicity shot.jpg

Both have since been deleted by Fastily for No permission, and I would appreciate some help in determining what the issues were:

1. I requested that the providers send in appropriate permissions; can someone tell me if they submitted letters of permission? I would have expected them to use the following email addresses, if that helps: Miriam Davidson miriamdvdsn@gmail.com or possibly director@annacrusis.com Catherine Roma <caroma129@gmail.com>

2. Both photos were given to me by the persons featured in the photos, on the basis that they were publicity shots and works for hire. My understanding is that the people who commissioned and paid for the publicity photos are therefore the copyright holders of the photos in question, and free to authorize me to release the photos on Wikimedia Commons. Is that acceptable?

Please advise if there is a better way to do this. I have a photo of another director, Jane Haulting, which I'd like to upload (this time taken by her husband, who is willing to give the appropriate permissions) but I want to make sure that there isn't something I'm doing wrong in the process before going ahead with that one.

The file descriptions for following files contain some pretty unlikely claims even though they've supposedly been vetted:

All of these are claimed to have been created by the subjects of the photos, but the photos don't look like selfies, and there is no metadata to indicate that they were taken using a timer release or remote control. What steps have been taken to ensure that the permission came from the right person and that the correct person is attributed as the author? LX (talk, contribs) 11:18, 16 August 2014 (UTC)[reply]

Could you check that the ticket is valid? Looking at w:Wikipedia:Files for deletion/2014 August 26#File:File Proposed EFU Building Rev1.jpg, the uploader seems to think that the file is a copyright violation. --Stefan4 (talk) 14:27, 26 August 2014 (UTC)[reply]

Backup KML files

I researched a lot vicinal Belgian railway lines, drew the lines in My maps on Google maps and linked them via Google Maps in articles. examples in:

nl:Buurtspoorwegen van de provincie Brabant#Geëlektrificeerde lijnen rond Brussel.

The underlying format KML files in My Maps are my ownership. (Google does not allow to make them community property) They can be used on any underlying maps, for example Openstreetmap. Unfortunately this format cannot imported in the Commons. The danger is if I die, My Maps in Google Maps wil be lost for the wikimedia community. I have zipped all the kml files. Can I send this file to OTRS as backup? Of course I give my permission to use these files under a opensource licence.Smiley.toerist (talk) 22:29, 26 August 2014 (UTC)[reply]

Confirming permission to reuse figure

Hi,

The Blausen files' permissions have previously been reconfirmed here by an OTRS user. In accordance with the file's Creative Commons Attribution 3.0 Unported license, you are free to reuse the image for whatever purpose you please, provided you credit the image's author and acknowledge the license. Aylssa Milano image request

I would like to register here and seek permission to use this image for non-commercial online digital use. I t will be converted to a .psd file and shared with others for use in signature tags, avatars, wallpapers, etc. No monetary or proprietary gain what so ever. http://www.peta2.com/heroes/alyssa-milano/

The file in question is File:Alyssa Milano 3.jpg, correct? Files hosted on Wikimedia Commons are free works, meaning you may use them not only for the purposes you listed but also for commercial purposes. You are, however, required to abide by the license requirements of each image. For the image I assume you're talking about, you can see in the Licensing section that its creator, PETA, has released it into the public domain allowing you to use it without even crediting the author. (Other files hosted on Commons are a little more restrictive; those that are licensed Creative Commons Attribution require you to list the creator(s) when reusing images, while others listed Creative Commons Attribution-Sharealike must include attribution AND any derivative products must be licensed Creative Commons as well.)
