JBarta, thanks again for your comments. You are right. The copyright follows the photo, not the photographer. The photographer has no claim to the copyright. We cleared up the situation. I have all rights to show these photos because the owned by me, it is my personal family archives.

You may have to do better with source and author (author=photographer). It's a little unlikely that you took a picture of your own grandfather when he was 3 years old. If it's a personal family photo that you scanned, you might wish to add that to source. (and scanning a photo does not make you the author) If you downloaded it from a web site, add the URL as the source. There is writing on the bottom of the image... is that the photographer? If so, add that to the author section. If the author(photographer) is unknown, then write "unknown". Also, a little more information in the description section would be useful... full names of the people in the photo would be a good start. In English and in Russian would be even more useful. You see, that brings up an interesting issue (one that on at least one occasion has been argued around here). If I go to a studio and pay a photographer to take a picture of me, does he then own the copyright on that photo? I'd say that's a pretty weak case... unless of course he sneaks such wording into the "reciept" I might sign. What if I hand my camera to an anonymous tourist to snap a photo of me and the family? Does the copyright then belong to this random fellow tourist? Again I would say not. A photographer certainly owns the copyright of his photographs.... unless he had been contracted (verbally or otherwise) to take a specific photo for someone. Then the copyright follows the photo, not the photographer. At least, that's what makes perfect sense to me. So in this case I would suggest you are wrong... the photographer has no claim to the copyright. I stand corrected. According to US Copyright Law, §201, section b)
Works Made for Hire.—In the case of a work made for hire, the employer or other person for whom the work was prepared is considered the author for purposes of this title, and, unless the parties have expressly agreed otherwise in a written instrument signed by them, owns all of the rights comprised in the copyright.
So that really depends on the studio and as you said, if you transfered the copyright to the photographer in written form (which is hard to prove). Lessons learned...--Trex2001 (talk) 08:02, 11 April 2012 (UTC)[reply]
Well, if we really want to put a fine point on the issue, we might say that here Russian copyright law is more relevant than U.S. copyright law as the photo was produced in Russia. That said, I think it's safe and reasonable to suggest that general principle of U.S. copyright law applies also to Russia. – JBarta (talk) 10:06, 11 April 2012 (UTC)[reply]
But thanks for pointing it out anyways, since very often i read on photography license discussions that the death of the photographer is the important argument. That said, another detail to keep your eye on. Thank you very much for your help. Certainly I did not take a picture of my grandfather when he was 5 years old. I`m a beginner in Wiki, so did a mistake, sorry. These pictures are from my family arhive. The first picture was made by Zelinsky photo studio in Baku approximately in 1910. This studio is not existing now. you can find information about it using this source: www.ourbaku.com On this picture you can see my young grandfather - Nikolay - and his sister Anna. The second picture is made by Eddie Photos (as seen on bottom) in New Britain. This photo studio is not exist now. This picture is also from my family archive. You can see my grandfather (right) with his friend during their trip to the US in 1930. thanks again. you did good job asking me all these things. I`ll be more attentive.
