Hi. We've received a letter from a person purporting to be the creator of this, claiming that it is in violation of his copyright. Even official coins in Australia are under copyright - Commons:Coins#Australia - but as an unofficial coin, this one would be under copyright to the designer. You noted on upload that this was "own work" - can I ask you clarify if you meant by that that you were the designer of the coin or simply that you photographed it? (If the latter, of course, it would be a derivative work.) Because of the complaint we've received, we really need to move quickly on resolving this, so your speedy response would be much appreciated. --Moonriddengirl (talk) 10:52, 6 May 2013 (UTC)
- It's a photograph I took of a keychain that I've had in my possession since about 1984. I think I know the person you're talking about, he's been posting at en:Talk:Brass razoo since January, apparently having a discussion with himself.[1][2] If there's a problem with the image I can photograph it another way, maybe as somebody holding a brass razoo on a keychain so that it's not the primary focus, which would seem to be OK based on this, or I could permanently solder it to my colorbond fence, which would seem to be OK under freedom of panorama as the fence is publicly accessible. --AussieLegend (talk) 15:24, 7 May 2013 (UTC)
- I'm not sure Feedom of Panorama applies when the rights holder doesn't approve the display. :) Otherwise, you could tack any copyrighted item to a fence in Australia and call it free. :D We'd probably have to open that one up to community discussion. Likewise, the issue with de minimis exceptions are that if the point of the image is the item - even if it's deemphasized - it's not de minimis. That's why that section says, " Ask yourself: Can the photo be used as an illustration for "Winnie the Pooh"?" If the photo could be used in an illustration about the article, it would probably not work. I'll see if I can get him to license it. --Moonriddengirl (talk) 15:35, 7 May 2013 (UTC)
- I don't think whether or not the rights holder approves the display is relevant. For example, in the foyer of a hotel is a statue, obviously copyrighted, on a table. Is a photo of the foyer a breach of copyright? Not in Australia it isn't, that's part of the purpose of FoP. You don't need to search for the copyright owner of an obscure piece of art just so you can include it in a photo. The local council investigated this thoroughly a few years ago, when it wanted to publish images captured during a photographic analysis of the community. While I have your attention, could you check if an email been received for File:Sydney Opera House by Kevin Kieberwirth.jpg. Images with permission on a third party site
Thanks for your thorough transfer of File:Australian ocean currents.png. In the future, could you please tag images which have valid permission on a third-party site as {{License review}} so that they can be tagged as verified? - Signing your posts is required on talk pages and it is a Commons policy to sign your posts on deletion requests, undeletion requests, and noticeboards. To do so, simply add four tildes (~~~~) at the end of your comments. Your user name or IP address (if you are not logged in) and a timestamp will then automatically be added when you save your comment. Signing your comments helps people to find out who said something and provides them with a link to your user/talk page (for further discussion).
