About my image Yun Family and the deletion request

According to South Korean Copyright law, if 50 years have past since one image's publication (that is an image that was published prior to 1960 would be in the public domain) the image is in the public domain. The website clearly states that this photo was published in 1952. Why is this NOT in the South Korean public domain? -Daffy123-

The Copyright

According to PD-South Korean copyright tag, all copyrighted works enter the public domain....50 years after publication when made public in the name of an organization. Therefore, if we deduct 50 years from the current 2010, if can be said that all copyrighted works prior to 1960 can be in the public domain. My image was taken in 1952. The portrait of Syng Man Rhee (Rhee Syng-Man in 1956.jpg) was taken in 1956. Rhee's portrait is in the public domain. Then why doesn't mine????

What I meant is that copyright persists 50 years after the publication date, not 50 years after the death of the subject. If that were to be true, pictures of Barack Obama or other people would never be in the public domain. Also it is clearly stated that one photo is in the public domain 50 years after the death of the maker(which you consistently assert) or 50 years after the publication. This photo was published and took in 1952. 50 years have passed and the copyright therefore expired in 2002. And please answer my question regarding Syngman Rhee's photo. And you're replys are very hard for me to read because it has omitted many verbs and nouns. I am a Korean user and I know that you are a Korean user. If you'd like, you can reply me in Korean. I repeat, copyright expires after 50 years of publication date. I have nothing more to say. For audio files and broadcasts, the term of protection ends 50 years after creation. According to Chapter IV Section 5 of the Copyright Act:

The protection period of neighboring rights shall come into effect from the following date and continue to subsist for a period of 50 years from the next year of such date:

1.For stage performances when the stage performance takes place; 2.For phonograms when the first fixation of sounds is made; and 3.For broadcastings when the broadcasting is made.)

Please stop making Edit Wars and make more use of discussion pages

Dear Idh0854, I appreciate that you want to help here on Commons, but most of your Edits are inappropriate. Starting Edit Wars on several files (File:Japan sea map.png, File:North Korea map-CIA (zh).png, File:General map of South Korea.png, File:North Korea launch site in Sea of Japan map.png, File:Korea north map.png, File:Korea south map.png, File:Map of korea.png, ...) is also NOT appreciated here on commons.

Please, please, please do not edit war again

This is also addressed to everyone reading this and it applies to any image. Please do not edit war images. Also, do not bring Wikipedia disputes to Commons. Just do not do it.

It is possible that some of you may not fully understand English, if so please ask at the Village Pump for help in understanding this important point.

Now, I have just created a derivative image of File:North Korea launch site in Sea of Japan map.png (see left) at File:North Korea launch site in Sea of Japan map - East Sea parentheses.png such that it contains the text "East Sea" in parentheses after "Sea of Japan" (see right).

Each Wikimedia project can now choose which version they want to use. Creating derivative images such as these at the left and the right is how to resolve such disputes. No edit warring needed at all.

As a note, both images referred to in this discussion need descriptions in Korean (even if the images themselves are in English) - Idh0854, if you want, why not post descriptions of those two in Korean? You can note in Korean that in one the name "Sea of Japan" is used, and in another both names are used. WhisperToMe (talk) 18:08, 27 August 2010 (UTC)

Some languages express things in different ways. Also some translations may have info that is not stated in other translations (i.e. the Japanese one may have statements that apply to users within Japan) - And on Commons some descriptions can have information in one language that isn't yet in another language. Meaning that you raise the issue on the Administrators' noticeboard about the disputed images (if the discussion has failed to resolve the issues) for further discussion with third party (uninvolved editors/Admins) opinions.
Also if you have a different version of a file never upload over an existing one as it is likely to be reverted and will always likely to turn into an edit war, so always upload as a new derivative work by using this tool.
I will be willing to unblock you (this also goes for Tm and Historiographer) if you agree to no longer edit war on any file on Commons, use talk pages (File or User talk pages) and use other means (such as taking it to COM:AN or COM:AN/U [if it is about another editor]). Idh0854님께서 한국 분이셔서 저는 그 파일에 대한 설명 말씀을 한국말로도 드리고 싶습니다. 1) 일본 제국 존재 했을 때 카자흐스탄, 그루지야, 러시아와 같은 국가가 없었습니다. 왜냐하면 지도에서 그를 현대처럼 독립국가로 그리면 이상하다고 봅니다. 2) 류큐 왕국은 1879년 전에 독립국가이었지만, 일본 통치 시대 식민지가 아니고 내지의 오키나와 현이었습니다. 또한, 당시 오키나와 사람들을 다른 내지인처럼 제국의회 선거에 투표할 수 있고 일본제국군대로 징병되었습니다. 따라서 오키나와를 내지로 그려야 한다고 봅니다. 1.제가 드리고 싶은 말씀은 우리가 역사작인 지도를 기리면 국경선도 역시적으로 그려야 한다는 것입니다. 예를 들면, 수(隋)나라의 지도를 그리고 그 지도에서 한반도가 보이면, 대한민국과 북한 대신 고구려, 신라와 백제를 그려야죠. 그러므로, 일본제국의 지도를 그리면, 현대 국경선 대신 당시 국경선으로 그려야죠.
2.물론, 오키나와 사람들은 차별을 받았습니다. 하지만, 지도에서 라임색으로 염색된 지역은 “일본으로부터 차별을 받은 지역”이나 “일본으로 강제 합방된 지역”이 아니고 “일본의 식민지”이죠. 그리고 일본제국 의 법률대로 식민지가 1889년 이후 합방된 지역이었습니다. 따라서 조선, 대만 그리고 가라후토 (사할린의 남쪽)가 식민지이었고, 오키나와와 쿠릴열도가 식민지가 아니었습니다.
또한, Idh0854님께서 조금 틀리신 것 같습니다. 1920년대 당시 일제가 대조선 (對朝鮮) 정책을 어느 정도로 자유화한 것이 사실이지만, 공식적으로 내지에 속하지 않았습니다.

  2. '아이누'(Ainu)가 살고 있던, 현재의 '홋카이도' 및 '사할린'은 그 민족의 의사(mind)를 반영하지 않은 채, '일본'이 개척지로 "점령"하게 됩니다. 또한, '일본'은 그 지역들을 개척 및 본토의 사람들을 이주시키되, 그 지역의 원래의 주민들을 쫒아내며, 민족성을 말살시키는 등의 모습을 보였습니다.
