Yeah, the author indicated via OTRS that he was okay leaving the second image, he just didn't want the first one to be released PD. Hi, You added a npd-tag to the file. Then you added a OTRS-ticket here but did not remove the npd-tag. From your edit-comment I am not sure if the added tickets content is enough permission or if adding the ticket should have solved the tag and you just forgot to remove it. It explicitly mentions the one picture, so while it's probable we can get permission we don't have it yet. I've just emailed and asked about it. Oh, and for future reference the ticket numbers that start with a year are linked to via Ticket:2011042310001936. The OTRS: syntax uses a different number. Well, it certainly wasn't a clear cut problem - it was on a federal site (which would usually make it automatically PD), but attributed to a state agency (which can claim copyright, and so we have to assume that they do without specific permission). In this case we also received a complaint from what certainly appeared to be the original photographer, although how the state agency ended up with their picture and passed it along to federal without attributing them I don't know. Thanks a lot for contributing to the Wikimedia Commons! Here's a tip to make your uploads more useful: Why not add some categories to describe them? This will help more people to find and use them.

Here's how:

1) If you're using the UploadWizard, you can add categories to each file when you describe it. Just click "more options" for the file and add the categories which make sense:

2) You can also pick the file from your list of uploads, edit the file description page, and manually add the category code at the end of the page.

[[Category:Category name]]

For example, if you are uploading a diagram showing the orbits of comets, you add the following code:

[[Category:Astronomical diagrams]]
[[Category:Comets]]

This will make the diagram show up in the categories "Astronomical diagrams" and "Comets".

When picking categories, try to choose a specific category ("Astronomical diagrams") over a generic one ("Illustrations").

As far as I can tell, it's not a free image. While you took the photograph and are releasing it under a free license, the medal itself is creative and thus copyrightable as well. This makes the image a derivative work, and it would thus require the copyright holder of the medal to release it under a free license as well. If I am mistaken and there is some reason why the medal itself is not copyrightable, in the public domain, already released under a free license, etc. please comment at the deletion request. The picture has not yet been reverted. It is a common medal in Pakistan for distinguished work. For Wikipedia fotogrpahy the medal was specially sent to a jeweler for luster and shine. I appreciate the reasons that you uploaded it and the effort that went in to it. I'm afraid, however, that none of that has any bearing on the suitability of the image for here on Commons. If the medal is copyrighted (which in the absence of evidence to the contrary we must assume that it is), then taking a photograph of it such as you did is creating a derivative work which is still subject to the copyright protection of the original.
As I stated above, if "there is some reason why the medal itself is not copyrightable, in the public domain, already released under a free license, etc." then please tell someone so that the image can be restored. VernoWhitney (talk) 16:27, 8 October 2012 (UTC)
Critically evaluate Flickr licenses
File:Taye Diggs Elton John Viewing Party.jpg has been marked as a copyright violation. You may have preserved the information shown on Flickr correctly when transferring the image here, but the Flickr uploader is not the copyright holder of this image. Either the image was created by someone else, or it is a derivative of someone else's work. As stated in Commons:Licensing, only the copyright holder may issue a license, so the one shown on Flickr is invalid. Always remember to critically evaluate Flickr licenses. Photostreams with professional-looking photographs, album covers, posters, and images in a wide range of styles or quality taken by many different cameras often indicate that the Flickr uploader either does not understand or does not care about copyright matters. See Commons:Questionable Flickr images for a list of known bad Flickr users.

Ford Museum uploads

Hello - Thank you for weighing in on the confusing copyright/public domain issues surrounding materials from the Presidential Libraries system (a branch of NARA). I appreciate your guidance. (I have more questions, still!)

Since NARA no longer has a PD template, I've decided to create one for the Presidential Libraries, since I'd like to grow our presence here. I'm working with Jim among others. I'd like to get as many Wiki-eyes on this as possible and then take it to NARA lawyers for their input, and then to the folks at Presidential Libraries for their input.

If you'd like to take a look at the language, the template is User:bdcousineau/PD-USGov-PresLib

After we upload the Ford materials, my plan is to continue with Presidential Library docs/photos prior to 1978 - seems a WHOLE lot easier. Also, not many Libraries have artifacts photographed at this point. Thanks! Bdcousineau (talk) 21:17, 4 January 2013 (UTC)

There seems to be a problem regarding the description and/or licensing of this particular file. It has been found that you've added in the image's description only a Template that's not a license and although it provides useful information about the image, it's not a valid license. Could you please resolve this problem, adding the license in the image linked above? You can edit the description page and change the text. Uploading a new version of the file does not change the description of the file. This page may give you more hints on which license to choose. Thank you.

Sam Mills Statue

Hey, I noticed you requested the picture for the Sam Mills statue be deleted. Is there any way to research the copyright status of a statue? I don't believe the Panthers copyrighted the statue, but I would like to find out so the picture can possibly be re-added. Toa Nidhiki05 (talk) 03:37, 30 January 2013 (UTC)

Depending upon when the statue was created, copyright may be automatic -- File:PD-US table.svg is a (very) brief and simplistic rundown of the basics for that. The Copyright Office's public catalog can be searched at http://cocatalog.loc.gov/cgi-bin/Pwebrecon.cgi?DB=local&PAGE=First but it can be hard to find what you're looking for unless you know the name of the statue or the artist/corporation which registered it. I tried the copyright searcher already, and there was nothing for a statue with codewords 'Carolina Panthers' or 'Sam Mills' - of course, it could fall under the designer (who I do not believe is known). Well, if the statue was created any time since March 2, 1989 it's pretty simple: it's automatically copyrighted no matter what and we would need an explicit release from the statue's copyright holder (whoever it is) in order to take a free photo of it. The statue was created sometime 1998 after Mills was inducted into the team's Hall of Honor. I did get a response via email from the Panthers general council, Richard Thigpen, on the issue:

There is not a problem if the photo is purely for personal use. It may not be used in any commercial context. Please let me know if you have more specific questions.

I saw you marked this file for missing permission. Please have a look at the talk page and the edit history. The image has been hosted on en.wikipedia before and was correctly transferred over here. Okay, I've now looked at the edit history and the talk page. I also looked at the deleted version of the image on enwiki. I didn't see verified permission anywhere. Just because an admin didn't check for evidence when they deleted the image there doesn't give an unsupported claim additional authenticity. VernoWhitney (talk) 20:35, 4 February 2013 (UTC)

I hadn't bothered with that step as they hadn't replied to any of the other messages left them in the years since they retired.

I see that you have been on here as you have been conversing with someone else.

So; will you now please respond to my questions as to why the file in question has been deleted despite the fact that I asked you not to, despite the fact that I gave you an avenue to contact me, and despite the fact that I have affirmed that i am, in fact, the copyright owner of this image?

I reply rather more quickly to people who give off rather less of a sense of entitlement. As a general rule I do not communicate about actions on Wikipedia or Wikimedia Commons via email. I am not the admin who deleted your image, I am only the editor who began the deletion discussion as there was no evidence that you were the copyright holder. In order for us to be able to accept previously published work, we need a verifiable statement of permission. Please see Commons:OTRS for the process. First of all, I would not have repeated my request in an ever-more strident manner had someone simply bothered to tell me what to do when I first asked some months ago (and then again in the following weeks) instead of simply ignoring me.

Secondly, I find it particularly galling that as a supposedly 'Open' and 'Inclusive' collaboration in the sharing and expansion of knowledge, your behaviour indicates the opposite - especially when someone who doesn't know your precious 'Rules' is treated with such disdain.

I honestly know very little about it, other than it got rave reviews. There's a newspaper article from 1877 indicating that it had just been put on display at Snow and May's Art Gallery and it looks like there was a photograph of the painting submitted to the Library of Congress. (And there's a cabinet card reproduction of that photograph for sale on eBay right now!). I did some research just now, but I wasn't able to turn up anything else. Sorry.
