Hello, you wrote [1] that you kept one image. But you deleted the image for which I wrote that it falls under FoP-Spain. As I remember the deleted File:Son Servera 03 ies.jpg only shows a part of File:Son Servera 01 ies.jpg (which was not nominated for deletion by nobody, but you added "kept" [2]). Thanks. I reached the same conclusion you did in your comment -- that the DR was a mess and I was slowly working though them.

When we get DRs like this one, I'd like to do a speedy keep and tell the nom to bring it back in pieces with a little more research. Trouble with that, though, is that the nom may not bother to bring it back, in which case the problems that are in the DR will remain on Commons. .     Jim . . . . Images de Temoudje sans licence

Bonjour,

Je viens de voir le message que tu as laissé sur la PDD de Temoudje à propos d'images sans licence. Cette utilisatrice a à priori quitté Commons mais je suis repassé sur la plupart des versement qu'elle a réalisés quand elle était en stage à la bibliothèque de Brest et j'ai pu supprimer un bandeau de licence par inadvertance (on m'a signalé un cas ce midi). Photos sur la page du général PE Jacquot sans licence

Bonjour,

je me permets de vous contacter (avec du mal, je n'ai pas l'habitude d'utiliser les outils de discussions)car je ne comprend toujours pas pourquoi vous avez fait supprimer 7 photos qui illustraient la page sur mon grand-père depuis maintenant 3 ans.

Comme je l'avais indiqué dans ma réponse, ces photos appartenaient à la collection privée de mon grand-père et ont été prises en général soit par un membre de la famille, par son photographe militaire attitré, à des fins purement personnelles. Sauf pour les deux coupures de journaux, vielles de + de 40 ans.

Merci de m'indiquer en quoi ces photos familiales enfreignaient un quelconque copyright et m’indiquer si possible ce que je peux faire pour que vous les restauriez ? Il m'est bien évidemment impossible de demander une quelque autorisation écrite, puisque ces photos m'appartiennent.

@Vrecourt88: Selon le droit français, toutes les photos ont un copyright par défaut, même si l'auteur est inconnu. Ce droit d'auteur expire habituellement 70 ans après la mort du photographe. Pour les photos publiées anonymement, ce droit expire 70 ans après la publication. En conséquence, aucune photo prise après 1943 ne peut être déposée sur Commons sans une permission expresse du photographe. Les photos en question ont été prises entre 1952 et 1960, il y a donc environ 60 ans. Vous me demandez d'obtenir une "autorisation expresse et écrite" de quelqu'un de ma famille qui est décédé depuis plus de 30 ans ? C'est bien comme cela qu'il faut que je comprenne votre réponse ? I did check, and it was written: "Some rights reserved". What does it mean to you? To me, if some rights are deserved, then the image is not useful for Wikipedia.

It is easy to see why you sent me the message you did on my talk page. However the only alternative is Bentley four-and-a-half-litre 1930. A Bentley 4,5-litre is a meaningless name to anyone with a knowledge of the subject. You throw away a famous (perhaps not to you) name and replace it with merely a common classification.

The act you request / endorse is not unlike a Wikipedian renaming of an article formerly Frenchman Napoleon to Frenchman Corsican - is that not where the man came from? Are there other famous Corsicans? He could still be found couldn't he. This is an encyclopaedia. Any reader just needs to think about it for a moment or two. Could any readers mind that? Yann, this is not a photograph; it is a drawing, which for all we know could have been created recently. The date listed for the image is actually the date of sinking, not the date of image creation. As I said above, this case is very well covered in the template: An artistic work other than a photograph (e.g. a painting), which was made available to the public (e.g. by publication or display at an exhibition) more than 70 years ago. This is not a modern drawing, and there is all reason to believe that it was created and published shortly after this event. Do not try to look for problems where there is none. Where is the support for the belief that it was created and published shortly after this event? We have recent examples, in fact in the very history of this image (when a recent painting by Ken Marschall was substituted for this image), of recent works of art of historic events being claimed to be public domain. Deux points au sujet de ce fichier. D'abord, il me semble impossible à retoucher... à l'exception, peut-être d'une ou deux grosses poussières en forme de S (ou de méandres). Donc, OK pour le sujet et pour l'auteur, imporetants tous les deux. Mais pourquoi ne pas proposer une version alternative en sépia puisque l'original n'est pas en N & B., et puisque la pratique du virage était courante à l'époque ? (voir photo de la Commune proposée par Paris16 en FP)... Pas très important, mais à toi de voir. -- Deuxièmement : j'ai plongé dans mes livres (presque aussi vieux que moi) et trouvé deux reproductions de cette image (mais pas du même tirage). Elles sont datées de 1854. Mes références datent de trente ans, la plus sérieuse étant le n° 1 de la collection "Photo-Poche" (1982). @cyb: Si, la photo est bien une oeuvre dérivée de l'affiche. Voir Commons:FOP#Canada. Pour les autres photos mentionnées, l'affiche ne comprend qu'un logo, qui peut-être considéré comme de minimis. Hi, Yann. I have been thought about people, who use Wikipedia only for self-promotion and uploading personal files without other useful contribution. I have nominated their all uploads for deletion and generally they get all deleted. But this request you closed as kept. Formally, yes, you are right, the file is used. But the user has not made any useful edits in Wikipedia. As much as I know, Commons has no policy about persons who make nothing in Wikipedia except userpage and uploading selfies for them. @Taivo: Yes, I understand your point of view. As you said, we don't have a policy against people uploading a few pictures of them. In fact, this is explicitly allowed. It would be better if people contribute, but deleting this image won't help about that. May be he will contrbute in the future. AGF. I'm just curious as to why the photo that I uploaded, File:Ryanleafdraft.png, was deleted. It says that there was some copyright problems, but as far as I know, the copyrights checked out since the photo was freely published on the internet, and the owner not only did not give proper info in the source, but also did not explicitly say that it was copyrighted. However, my investigation skills are not ideal, so I would like some input. Please reply to me message on my talk page on the English wiki, which can be found here.

Hello Yann,

I have made a DR on an image which is made in France. We have here a special case because the bridge, which is the main object of the image, is situated on the german-french border. But from my comprehension this bridge (build 2006-2007) is protected by copyright of the architect. Images from Germany are coverd by the Freedom of Panorama, so no problem. Either because the copyright is quite dubious or nobody really care. This is the typical arbitrary rule put against ordinary people: a completely inapplicable rule is created. Your admonition is misplaced. I have not knowingly or willingly violated any copyright rules of Wikimedia Commons or any other entity associated therein. In fact, I have done my utmost to correctly and credibly source each entry that was not from my personal archives. I have only added those images that I thought would improve the texture and understanding of written words in the articles I edit. Those images that were from my personal archives for which you added Deletion Requests on my Talk page have been directly justified with clear evidentiary statements in my responses to you on your Talk page.
Would it not serve the Wiki community better for you to offer help BEFORE you make judgment, then to mark-up, delete and then after the fact offer your help?
As a result of your wholesale deletion of everything I tried to do to improve the articles I have edited, I have decided not to use Wikimedia to upload anything until I have resolved my dispute with you directly with the editorial community. Wikipedia and Wikimedia Commons are supposed to be a collegiate exercise in helping each other, not mocking and not treating us as if everything we have done is wrong. I strongly object to what you did today - if this is what Wiki is all about, I no longer wish to participate in this project.

Dear Yann, I have responded now to each of the deletion requests you made. The obvious violations that were deleted (Jones Chamber of Commerce or Jones Atlantic Council), which I did not understand were such because when I uploaded, I made clear that I did not know what the licensing was and that I found these images on the internet, which images I thought enhanced the articles I was editing.

Your subsequent deletion requests of materials that are genuinely my own (my weightlifting photos or my All-American certificate, etc) show bias and malice in the wholesale manner in which your deletion requests were made. If there is something I have genuinely done to violate Wikimedia rules, I will voluntarily delete or ask something to be deleted. I am even happy to just stop contributing in positive ways to Wikimedia and Wikipedia altogether if I am deemed to be violating the rules so unceremoniously. But this is not at all what I have done. I have made contributions from my private archives that are my own to give and license for the benefit of the public at large because most of the uploaded contributions have historical value and give important context to the articles I am editing.

Your cavalier assertions simply ignore all that, as if you know better than I do what is mine to give, and what is under my authority to license to the public domain. I am perhaps not as seasoned an editor as you are, but rather than taking the stance you did, you could have also placed a note on my talk page to ask me why I licensed something the way I did, and if I was wrong because I do not understand something, either we jointly agree to delete it or I re-upload with proper licensing. I am willing to learn. I am not prepared to let someone's agenda against my person be played out in public.

Certainly, of the ones above, the Bashir letter, the Kashmir letter, the Clinton photo (White House), the GenAbe and Reagan photo qualify as US Government public materials. The weightlifting is my personal material from my personal archive. I don't see any way in which you can question that.

Help Request with Redundant Image Upload

Hi Yann,

Can you help me figure out how to re-upload this particular image? It was originally uploaded by another user that I had asked to do so when I was not aware of how to upload images. The Wikimedia Upload Wizard now makes that process so much easier. I do not know how to delete that image, and still wish to use the image in my Wikipedia Article.

I thought I uploaded it correctly this afternoon but it still shows when I log in to my account as some sort of problem.

For the newspapers, depending of which country they were published, the copyright can last from 30 years after publication upto 70 after the death of the photographer. The Hotchkiss picture is the correct class, date is 1923. It is a scan from yearbook in public domain. I put as owner as I did not see any option for out of copyright public domain work. Feel free to change accordingly, but class year is correct.

Sorry for not answering before. I don't think there is a policy about special cases like this one, but I know that creating a DR and closing it immediately has been done by several admins. Since when has obvious sockpuppet crap not been speedy deletable? See the tracking category on en-wp and my deletion nomination history here in Commons. File:Tabumonerekho2.jpg and its other versions have been uploaded here by vandal countless times. Somebody should start blocking the many Surjendranal socks in Commons. Family pictures are a bit of a problem here. Commons is very strict, and requires a permission from the photographer, or that there are in the public domain. Even pictures from the 1930's are not readily accepted. If the photographer is not known, it then depends if they were published, and where. Sorry. Hi Yann,

The particular picture that has been deleted was placed on the internet already; we gave permission for an obituary website to display it. So in regards to File:Jose_Amparado_Rosabal.jpg, how can I have it reverted back to wiki without a problem?

In regards to the photos from 1930's, I suppose the best bet would be to place them as photos for the public domain? I really would much rather have them placed as family property (we are very certain they have not been published by anyone).

Copyright Tags on My Images.

Good morning. I have received a plethora of Copyright claims, sent by you, on works that Me, Myself and I have created and uploaded onto Wikimedia Commons for use on Wikipedia. I would kindly like to ask why this is? Why do I need to provide permission information for something that I created and uploaded? Am I really that famous that I need to prove it's me? I'm pretty sure a lot of people have never heard of me or my works! :P Also, that February 19 expiration date is pretty harsh! It's 3am in the morning on February 20 here, and I'm starting to think this is both a conspiracy to kick me of Wikimedia and a conspiracy to keep me awake with 11+ email notifications! I do not see privacy issues with version I kept. Let's imagine, that she will become a famous scientist or politician and some newspaper finds the photo and publishes it: when she was younger, then she looked like that. And so? But encyclopedic value was weak, nothing irreplaceable here, valuable only as stock photo, so ... this was not big loss for Commons. For me, case closed. For reasons I don't understand, your reference to the specific discussion on my talk page did not create a ping -- I think for a ping to happen you must refer to a user, not link a talk page.
It is true that I didn't notice your comments when I closed the DR. However, your misrepresentation comes with failing to mention that at your instigation I went back to the DR and considered each of your comments in detail, including making comments.
Your comments in the 1st DR — interspersed among mine with no distinguishing formatting and no signature or date (just like the one above by the way; something wrong with your tilde key?) — were added after the DR was closed by you. (Also an unorthodox thing, to add stuff to the blue area.) In the undeletion request I stated that when you closed the DR you were not aware of my expanded keep-vote rationales, because I created a subheader, something I learned from you. Your subsequent comments simply confirm your opinion, but the process allowed more views to be given to the matter and the fate of these images doesn’t depend on any legality about the closing of the 1st DR. Consultation on deletion of a picture "File:Jorge-Felipe de Sajonia-Gessaphe.jpg"

Dear Yann, you are right in delete the other photo (named: "File:Hereditary+Prince+Hubertus+Saxe+Coburg+Gotha+qqvx0r42zIhl.jpg"), although it is freely available on internet, she has a copyright by his author. I really misunderstood the Wikimedia Commons rules about that.

In the other photo that I upload (named: "File:Jorge-Felipe de Sajonia-Gessaphe.jpg") although all the pics of the website whence comes the aforementioned are copyrighted, the photo in question was edited by me and is not the same to the one that is shown in the original website. Does this fact have any impact in the deletion made by you? or do not have the lowest importance...

Yann, I think you incorrectly removed the speedy tag from File:Asit Kumar Haldar 1913 The Beginning Tagore.jpg. This file was deleted per Commons:Deletion_requests/Files_in_Category:Asit_Kumar_Haldar as it's only PD in the US, not in its source country, it was then temporarily undeleted and tagged with {{PD-US-1923-abroad-delete}} so that the bot User:Commons fair use upload bot would transfer it the appropriate local wikis. The bot did the transfer, and when done, the bot tagged the image for speedy deletion. Yes it's PD in US. That's the point -- we know it was published in the US in 1913, but we don't have any evidence that is PD in it's source country (India). See the DR discussion. Mumbai Monorail RDs

Hi! This is in relation with following 15 RDs. I don't quite understand how you have decided to keep all these images. Do you mean it's okay to host images on Commons that do not allow derivation? COM:L says "Publication of derivative work must be allowed." (italics in original text)

In case we are permitting this, we have many other sources of Indian Government websites which can be used. Earlier some user had asked me a doubt about [7] and reading and interpreting it i had asked him that we can not host images from pib.nic.in. Bandeau de suppression inapproprié

J'ai bien reçu ton avis de refus concernant le fichier Pinda Sveda ayurvédique.jpg suite à ma demande d'authentification de droits d'auteur effectuée ce 21 février sur Commons : Service d'aide et le comprends parfaitement puisque je me posais moi-même la question. Je m'étonne simplement qu'une simple demande de renseignements aboutisse pour la deuxième fois à l'apposition sur ma page de discussion du même bandeau de violation de droits d'auteur qu'une véritable violation car il contient cette phrase inadmissible dans mon cas : "Wikimedia Commons takes copyright violations very seriously and persistent violators will be blocked from editing". Ce qui fait très « mauvais genre » sur une page de discussion personnelle.

N'y aurait-il pas moyen dans l'avenir de distinguer les deux procédures et d'utiliser un autre type de bandeau de suppression afin de ne plus se voir affligé d'une telle horreur après une innocente demande de renseignements ou bien ce procédé est-il destiné à décourager de telles demandes ?

Désolé, mais c'est la procédure habituelle, quand on trouve une image copiée depuis Internet, dont, en plus, il manque la licence. Dans au moins 99% des cas, c'est une violation des droits d'auteur, et nous n'avons aucun moyen de le savoir sans autre information de l'auteur. This picture has explicit consent from Neil Gaiman to be used on this wikipedia page. The picture if from his twitter feed how would I go about getting this image to stay on Rick Berry's wiki page with this permission granted. RJ Balaji photo

I have sent OTRS the following mail. Hope it will look acceptable:

The Chennai-based photographer Vithun Ravindran shot a picture of two men: RJ Balaji (the man with glasses) and rapper Aadhi. I have attached the picture to this mail. Although he has given me permission to use the picture on Wikimedia Commons, he has refused to mail OTRS. As a result, I have photographed the written permission he gave and attached it to this mail. Because Balaji is the main subject in the image, I have also attached to this mail a cropped version of Vithun's picture that shows only Balaji.

And attached to the mail are three photos: Vithun's permission, the image of Balaji and another man, and the third one is the cropped version featuring only Balaji. Have I done right? Kailash29792 (talk) 16:28, 25 February 2014 (UTC)[reply]

Don Suisse reproduction photos

Bonjour Yann, Merci de votre message. J'aimerai compléter l'article existant sur Wikipedia relatif au Don Suisse pour les victimes de la guerre. Pour ce faire, j'ai eu accès récemment au Rapport général sur cette action qui s'est déroulée entre 1944 et 1948. Ce rapport date de 1949 et présente un certain nombre de photographies d'époque dont j'ai cité les crédits des auteurs indiqués dans le rapport. Merci de me dire exactement ce que je dois faire pour utiliser ces documents pour illustrer l'article précité. Les photos sont dans le domaine public en Suisse 70 ans après la mort du photographe. En conséquence, il faut une permission pour les photos datant d’après 1943. Voyez COM:OTRS/fr pour la procédure. Vous pouvez sans autre utiliser cet ouvrage tant que, en effet, vous citez les références de cet ouvrage. Le droit d’auteur ne serait contrarier que si vous dupliquiez des passages sans en mentionner la provenance ; c’est-à-dire les références de l’ouvrage source. Le livre vous appartenant à présent, la Bibliothèque du Parlement ne peut en aucun cas être impliquée dans l’utilisation que vous faites du contenu de ce document.
