Goodies, tips, and tricks

Hi Not sure where to put this question. Hope I have it right. Apologies if I placed it in the wrong spot.

What do I have to do to be able to use the harvest image. Can the daughter of the artist give me the right to use it without giving permission to everyone. Thanks in advance for your advice.

I'm going to cut and paste material that I think permits me to take photos of the mural that my article is about and to use these photos in my Wikipedia article.

Perhaps there is no new information below for you and you have other thoughts and documents to back up you thought that the images should be deleted. I'm putting all the raw information below for your information and for the information of others.

As you can imagine, without these images, I will be required to remove my article. So this is a serious matter.

Freedom of panorama (FOP) is a provision in the copyright laws of various jurisdictions that permits taking photographs and video footage and creating other images (such as paintings) of buildings and sometimes sculptures and other art works which are permanently located in a public place, without infringing on any copyright that may otherwise subsist in such works, and the publishing of such images. Panorama freedom statutes or case law limit the right of the copyright owner to take action for breach of copyright against the creators and distributors of such images. It is an exception to the normal rule that the copyright owner has the exclusive right to authorize the creation and distribution of derivative works. The phrase is derived from the German term Panoramafreiheit ("panorama freedom").

A file that you have uploaded to Wikimedia Commons, File:Cochineal harvest.jpg, is a derivative work, containing an "image within an image". Whenever you take a photo of someone else's work, there's a very good chance that such a photo is going to be considered a derivative work; this is particularly true if whatever you photograph is a creative work (e.g. artwork, signboard, corporate logo, building) regardless of whether it's publicly displayed. So, the copyright status of whatever you've photographed needs to be assessed if you're going to upload your photo to Commons because Commons will only accept content that is 100% free or within the public domain. Moreover, since Commons is a global project whose file storing servers are located in the US, the content needs to be 100% free or within the public domain in both the United States and its country of origin (country of first publication).

Assuming that you aren't the artist who painted the murals you photographed, you can't really upload photos of the murals without either (1) the artist's COM:CONSENT or (2) some kind of evidence that the murals are not protected by copyright per COM:MURALS. What you've technically done here with these photos is to release them under a license that states you're the copyright holder of the mural as well, but that's not really the case. Sometimes when you photograph a work of art, it may be so old that it's no longer eligible for copyright protection or installed at some location where it's OK to do so even if it's still protected by copyright, but such things can vary quite a bit from country to country. That is often why it's much better for the copyright license you choose when uploading the photo to applicable to what's in the photo as opposed to simply the photo itself. If the photo is your COM:Own work, creative enough to generate its own copyright separate of what's in the photo (that's not the case with these photos), and you want to release it under a free license, then you can; you still, however, may also need to address the copyright status of whatever you photograph.
