Hi Not sure where to put this question. Hope I have it right. Apologies if I placed it in the wrong spot.

What do I have to do to be able to use the harvest image. Can the daughter of the artist give me the right to use it without giving permission to everyone. Thanks in advance for your advice.

I'm going to cut and paste material that I think permits me to take photos of the mural that my article is about and to use these photos in my Wikipedia article.
Perhaps there is no new information below for you and you have other thoughts and documents to back up you thought that the images should be deleted. I'm putting all the raw information below for your information and for the information of others.
As you can imagine, without these images, I will be required to remove my article. So this is a serious matter.

Freedom of panorama (FOP) is a provision in the copyright laws of various jurisdictions that permits taking photographs and video footage and creating other images (such as paintings) of buildings and sometimes sculptures and other art works which are permanently located in a public place, without infringing on any copyright that may otherwise subsist in such works, and the publishing of such images. Panorama freedom statutes or case law limit the right of the copyright owner to take action for breach of copyright against the creators and distributors of such images. It is an exception to the normal rule that the copyright owner has the exclusive right to authorize the creation and distribution of derivative works. The phrase is derived from the German term Panoramafreiheit ("panorama freedom").

Mexico's federal copyright law, Article 148, allows reproduction without compensation in certain circumstances:

The term lugares publicos has been interpreted to include both interior and exterior public places. Government-owned places such as libraries, markets, parks and public gardens have no restrictions against freedom of panorama. However, due to the ambiguity of the article, on some occasions, some establishments like the Mexico City Metro (a government-owned system) have required users to request permission to film or photograph inside the facilities. The Federal Law of Telecom and Broadcasting also uses the term "public places". It defines public places as: "...those that are in the charge of dependencies of federal, state or municipal entities, or under public programs of any one of the three orders of government..." Public places under this law (page 7) would include:
Schools, Universities, and every kind of building used for education;
Clinics, Hospitals, and every kind of building used for health care;
Government offices of all types;
Community Centers;
Free admission and open places such as parks, green areas and sports centers
Places that collaborate in public federal programs.

@ArbyBB The article's retention is a matter for the version of Wikipedia where it is published. Note, please, that it is not your article, but is Wikipedia's. The statement that you will be forced to remove it is capable of interpretation as some form of threat, something you must not make. It would behove you to retract that. Even if you do not do so it will make no difference to the administrative decisions to keep or delete these files. Files on Commons are treated entirely on their merits. Thanks for the clarification about the text not being my article. I get it.
My thinking was that without images the article is meaningless. Perhaps there is a work around for that.

I see you have found the deletion discussion. Thank you for leaving your comments there, where they will be considered by the administrator who closes the discussion.
The article itself is of no interest to Commons, I'm afraid. I'm aware that Commons looks similar to Wikipedia, but each has a different function. Commons is a repository for files that are freely licensed. Wikipedia(s) are repositories for articles. Those articles may call on files from Commons. Various Wikipedias also hold files, and each has its own rules for doing so.
Articles need to be discussed on the relevant Wikipedia

Timtrent Thanks for your efforts to facilitate smooth communication in Wikipedia. The concept of Wikipedia is wonderful. I was reminded of that recently. The idea behind the article i started in Wikipedia was to provide information to tourists visiting Oaxaca, Mexico. But the other night in a conversation with an 18 year old in Mexico, I showed him the page and he was very interested. He talked about his teacher taking him there. I realize now that with a Spanish version of the article in the hands of teachers in Oaxaca they will have another tool to teach the history of Oaxaca and Mexico. The answer is to work on the article(s) on the relevant language versions of Wikipedia so that the pictures are interesting but are not essential to the article. In that way the existence or not of a picture to illustrate a point becomes useful but not important. This is a genuinely interesting writing task, and is real work.
Regrettably, the Commons threshold for inclusion has nothing to do with whether a file is interesting. Commons is only concerned with whether a picture is in scope - See Commons:Scope - and whether it is licenced correctly and lawfully. It is a rigorous environment where opinions must yield to facts. Whenever you take a photo of someone else's work, there's a very good chance that such a photo is going to be considered a derivative work; this is particularly true if whatever you photograph is a creative work (e.g. artwork, signboard, corporate logo, building) regardless of whether it's publicly displayed. So, the copyright status of whatever you've photographed needs to be assessed if you're going to upload your photo to Commons because Commons will only accept content that is 100% free or within the public domain. Moreover, since Commons is a global project whose file storing servers are located in the US, the content needs to be 100% free or within the public domain in both the United States and its country of origin (country of first publication).
Assuming that you aren't the artist who painted the murals you photographed, you can't really upload photos of the murals without either (1) the artist's COM:CONSENT or (2) some kind of evidence that the murals are not protected by copyright per COM:MURALS. What you've technically done here with these photos is to release them under a license that states you're the copyright holder of the mural as well, but that's not really the case. Sometimes when you photograph a work of art, it may be so old that it's no longer eligible for copyright protection or installed at some location where it's OK to do so even if it's still protected by copyright, but such things can vary quite a bit from country to country. That is often why it's much better for the copyright license you choose when uploading the photo to applicable to what's in the photo as opposed to simply the photo itself. If the photo is your COM:Own work, creative enough to generate its own copyright separate of what's in the photo (that's not the case with these photos), and you want to release it under a free license, then you can; you still, however, may also need to address the copyright status of whatever you photograph. Pay attention to licensing
Wikimedia Commons only accepts free content: images and other media files that can be used by anyone, for any purpose.

File:Juarez y Diaz.jpg seems to be free (or it would be proposed for deletion), but it was identified as having a wrong license. Usually, it is because a public domain image is tagged with a free license, or because the stated source or other information is not sufficient to prove the selected tag is correct. Please verify that you applied the correct license tag for this file.
