Please sign your name on Talk pages by typing ~~~~. To link to an image page without embedding the image, type: [[:File:Foo.jpg]], which produces: File:Foo.jpg. You may enable gadgets (custom features) for your account. There are several tools to upload files. Have you edited Wikipedia before? This guide might be useful. Made a mistake? Do you want to have a file renamed or moved? Use the move link and wait for an authorized user to rename it. Do you want to have your recently uploaded picture removed? I notice that the file page either doesn't contain enough information about the license or it contains contradictory information about the license, so the copyright status is unclear. If you created this file yourself, then you must provide a valid copyright tag. For example, you can tag it with {{self|GFDL|cc-by-sa-all}} to release it under the multi-license GFDL plus Creative Commons Attribution-ShareAlike All-version license or you can tag it with {{PD-self}} to release it into the public domain. (See Commons:Copyright tags for the full list of license tags that you can use.) I'm sorry that my colleague closed this without giving you the help that you asked for.

The issue here is that we do not know who took the image or when it was first published. I am afraid that US copyright law is notably complicated, so please bear with me.

An image from 1935, that was published then, is probably in the public domain -- in order to still be under copyright, it would have to have been published with a copyright notice (likely) and its copyright registration would have had to be renewed 28 years later (extremely unlikely). So, if you can show that it was published around the time it was taken, we can restore it on Commons.

However, you say that it "was a private family picture", which makes it unlikely that it was published then. If that is the case, then its appearance on Commons may have been its first publication. If so, then:

• if the author is known, copyright runs for 70 years after the death of the author.
• if the author is not known, then copyright runs until the earlier of 120 years after creation or 95 years after publication -- which in this case would be until 2055.

This looks to me like a professional photograph -- remember that back then it was much harder to take photographs than it is now and this is an excellent portrait. If that's true, there is probably no way to keep it here. My guess that if you cannot show that it was published before 1963, then the only way we could restore it is if you can show that the photographer died before 1943 or that you are the sole heir of the photographer -- then you would own the copyright and could license it.

Thank you, Jim. It's disappointing because we have so many family pictures, especially of Rosa Poli because she lived until 1960, but very few of Sylvester Poli. The photography was done by Curtiss Studio in New Haven, CT. The only information I could find out about them is that they did mostly wedding pictures. Some as old as the early 1900's. I could find no close of business date, or who the individual owner(s) might have been. --Gramps101 (talk) 18:29, 26 May 2013 (UTC)

I'm afraid that's the end of it, then. The image is what we call an "orphan" -- still under copyright, but the copyright holder is unknown. Unless you can show that it was published before 1963, in which case we can assume that the registration was not renewed, we would need a license from Curtiss's successor as copyright holder. .     Jim . . . .
