Bonjour, D'après l'article Jenny de Vasson, on croit comprendre que ses photographies n'ont été publiées pour la première fois qu'en 1982. Est-ce le cas ? Les photographies sont dans le domaine public en France mais les pages de description des fichiers sur Commons ne mentionnent pas leur statut aux États-Unis. Quel est-il ? Serait-ce copyright jusqu'en 2048 ? Le livre de 1982 contient-il une note de copyright ? Si oui, quel en est la formulation exacte ? -- Asclepias (talk) 17:11, 3 August 2020 (UTC)

Bonjour, La détermination du statut de ces photos est complexe à cause des excentricités du droit étatsunien en cette matière, en particulier pour des oeuvres publiées entre 1978 et 1989 à l'extérieur des États-Unis. Ça dépasse mes connaissances rudimentaires du droit de ce pays. Mon idée serait de poser la question sur la page VP/Copyright pour tenter d'avoir les réponses des spécialistes de ce droit. Mais pour poser la question pour qu'il soit possible d'y répondre, il faut fournir tous les faits qui peuvent être pertinents.
Le livre contient probablement certains de ces faits. Je n'ai pas trouvé d'extraits du livre en ligne. Je suppose que vous en avez une copie papier. Je vais donc mentionner ici quelques questions auxquelles j'espère que vous pourrez répondre, si vous le voulez bien. Chaque petit détail sur ces questions, bien qu'il puisse nous sembler insignifiant, peut en fait être important et pourrait faire la différence pour déterminer si les photos sont sous copyright ou dans le domaine public aux États-Unis et, en conséquence, si elles peuvent être conservées sur Commons ou si elles doivent en être supprimées.
  • D'après votre réponse précédente, on sait qu'il y a a présence d'une note de copyright, sous la forme «Copyright éditions Herscher». L'année est-elle écrite, par exemple «Copyright éditions Herscher 1982» ou sur la même page ou ailleurs ?
  • Connaît-on la date précise (jour, mois) en 1979 à laquelle la «découverte» a été divulguée ?
  • Était-il possible pour le public dès cette date en 1979, ou entre cette date et 1982, de voir les photos, par exemple lors de l'annonce de la «découverte» ou en exposition, ou dans des articles de journaux, ou en ligne ou autrement ?
  • Sait-on qui était propriétaire des objets, plaques photographiques, albums, tirages, au moment de la divulgation de la «découverte» en 1979 et de la publication du livre en 1982 ? Les héritiers de Jenny de Vasson étaient-ils alors propriétaires de ces objets ou Zaorski ou quelqu'un d'autre s'en était-il porté acquéreur ?
(Digression : Que les photographies aient été «découvertes» en 1979 est une coïncidence plutôt frappante quand même, puisque, suivant la version du Code de la propriété intellectuelle qui était en vigueur en France à ce moment, 1979 serait justement l'année-charnière lors de laquelle les droits d'auteur patrimoniaux des héritiers de Jenny de Vasson ont expiré et, s'il n'y a pas eu publication avant cette date, des droits potentiels d'exploitation auraient été créés au bénéfice du propriétaire des plaques photographiques, d'une durée de 25 ans après la première publication des photos. Merci de vos réponses rapides et précises. Bien oui, ce serait triste de devoir se priver des photos. C'est pour ça qu'il est important de clarifier la situation dès que possible, plutôt que les photos soient supprimées dans quelques mois ou dans quelques années, sans véritable recherche, simplement parce que quelqu'un aura remarqué, tôt ou tard, que leur statut aux États-Unis n'est pas correctement indiqué. On voit pratiquement tous les jours des fichiers, fort possiblement du domaine public, être supprimés de Commons parce que les utilisateurs n'avaient pas fourni les informations suffisantes lors du téléversement il y a plusieurs années et que personne n'est suffisamment motivé pour faire la recherche. Attendre que ça se produise n'est pas une bonne solution. Je sauve parfois quelques fichiers en faisant la recherche, mais cela demande un travail plutôt lourd. Il vaut mieux clarifier maintenant, même au risque d'une réponse négative. J'ai soumis la question sur la page Commons:Village pump/Copyright#Photographs by Jenny de Vasson. On verra ce que ça donne. On peut espérer que les photos seront identifiées de façon sécuritaire comme étant dans le domaine public. Au pire, elles seront supprimées de Commons comme non-libres aux États-Unis mais on saura au moins en quelle année elles pourront être restaurées sur Commons et il sera possible de s'adresser au propriétaire des droits aux États-Unis pour demander s'il serait disposé à offrir une licence libre. -- Asclepias (talk) 18:48, 5 August 2020 (UTC)

Or, il n'y a aucune telle licence à la source mentionnée et tu n'indiques pas d'autre source d'où proviendrait cette licence. Bonjour, ce doit être une erreur, je pense que j'ai copié sur la licence d'une autre photo Harcourt mal choisie. Le concours Wiki Loves Monuments France est ouvert pour une semaine encore, jusqu'au 30 septembre. Déjà plus de 6 000 photos ont été importées cette année alors vous aussi rejoignez le concours ! Cette campagne de contribution concerne tous les monuments et objets mobiliers présents dans la base Mérimée et dans la base Palissy. De l'imposant château aux ruines industrielles, de la verrière décorative au reliquaire, c'est un impressionnant patrimoine qui attend d'être photographié et documenté. Vous pouvez dès à présent mettre en ligne autant de photos que vous le souhaitez de ces monuments et objets du patrimoine français. Nous attendons vos photos avec impatience !

Les plus belles photos seront sélectionnées par un jury national composé d'amateurs et de professionnels, de contributeurs à Wikimedia Commons et d'acteurs du patrimoine. Un jury international constituera ensuite une sélection des meilleures photographies mondiales.

Si vous avez des questions, l'équipe organisatrice se fera un plaisir d'y répondre.

Hi Siren-Com. I noticed that you've made a malformed deletion request. Here, {{Delete}} is not for speedy deletion, please see COM:DP. When you want to delete a page by manually using the {{Delete}} template (rather than the automatic Nominate for deletion or Nominate category for discussion tool in the Tools menu on the sidebar per COM:DR#Starting requests and COM:CFD#Starting requests), you must follow the instructions in the template, including the "Click here to show further instructions" portion (or Commons:Deletion requests/Listing a request manually policy or the "By hand" portion of COM:CFD#Starting requests, normally collapsed), otherwise you will create a lot of work for other people.   — Jeff G. ツ please ping or talk to me 14:26, 29 August 2022 (UTC)
