Works licensed under Cc-Gobierno de Chile[edit]

Hi, I noticed that you've been nominating various images with a {{Cc-Gobierno de Chile}} tag for speedy deletion. Note that speedy deletion is only for obvious cases, where a patrolling admin can immediately understand why the image is not freely licensed as stated. Please use the regular COM:DR process in the future for these kinds of images. Hi, note that "unlikely own work" is not a valid reason for speedy deletion. I've converted some of your tags to regular DRs: Commons:Deletion requests/File:Pedro María Ramírez.png. COM:CSD#F1 says: "Content is a clear copyright violation, with evidence that no Commons-compatible licensing has been issued by the copyright holder." The speedy deletion tagger must provide evidence of their position, which usually comes in the form of a link to another copy on the web which is older and at least as large as the version on Commons, and which does not have a free license indicated at the external site. Short copyright periods for photos[edit]

I see that you tagged File:Gino Meschiari.jpg for speedy deletion with the rationale "not released under that license". In general, COM:CSD#F1 requires proof of copyvio and reasonable confidence that the image cannot possibly be public domain, so for these older photos it is better to use regular COM:DR. However, in this case it qualifies for {{PD-Italy}}, since the subject died in 1947 (and so any photo of them must have been taken before then). See Commons:Copyright rules/Photographs for more info on which countries have a special short copyright term for photos, including but not limited to Italy, Spain, Poland, Argentina, and Peru. Also be careful about US works (of any type, not just photos) prior to 1989, because they may be public domain as well (see Commons:Copyright rules by territory/United States#Copyright formalities). -- King of ♥ ♦ ♣ ♠ 04:23, 27 February 2023 (UTC)[reply]

Reversiones[edit]

La plantilla que colocas en mis fotos dice que "si no es considerado para borrado rápido, se retire la plantilla" y que te deje un mensaje. Bueno, las fotos de Ana Torin fueron tomadas con mi celular, nunca he tenido un iPhone como equipo personal, sin embargo, he tomado fotos con otros dispositivos. Sin embargo, aunque tomé las fotos, y obviamente fui el fotógrafo, si no puedo demostrar que el equipo es mío, entiendo que hagan un borrado, está bien, pero, ¿las de Ana fueron tomadas con un iPhone? Y la del grupo 123 Andrés, lamento no haberla tomado con mi celular, sino con la cámara de otra persona, creí que yo tenía que ser el fotógrafo, no el dueño del equipo. Commemorative plaque with engrave (free license?)[edit]

Buenas. Since you know more about copyright in Chile than I do, I would like to ask you something. You see, there is an image of the prominent Chilean lawyer and jurist René Ramos Pazos, which I would like to add to Commons. The problem is that I don't know if it can be shared through a free license, since it is an engraving, which is on a commemorative plaque, at the entrance to the Universidad de Concepción School of Law Library. I would really appreciate it if you could answer that question for me.

Chilean Threshold of originality.[edit]

It's a messy subject to be honest. Actually you could submit a drawing of letter "a" in whatever font you find using a digital program/app, and the Departamento de Propiedad Intelectual could grant you a Registro de Propiedad Intelectual (Intellectual Property Registry) number. What most misunderstand, however, is that registering the work does not imply necessarily that it is copyrighted. It serves merely as an "assertion" of copyright. That means that if the work ends up in the middle of a lawsuit, the registry could be used to "assert" (not prove) it is your work and that it is copyrighted. I strongly disagree, as a result, with the example given in the TOO Chile page. It has not been judicially confirmed that phrase (in that particular writing) is copyrighted. We could assume that, in Chile, the threshold of originality is very low or that there is no threshold of originality at all if there is no judicial sentence. In some cases, they are supposedluy based on other works, but if you check them... I cannot see relevant resemblance (for instance Escudo de Arica.svg with Coat of arms of Bolivia.svg (they only took the mountain), nor say where they based the artworks as to be an "official" coat of arms. Violaciones de copyright[edit]

Buenos días, te escribo porque me di cuenta de que borraste un archivo que subí, y a continuación varios otros más. El primero de ellos, una imagen del escudo de Palmilla, se encontraba con la licencia correcta, pues solicité a través de las plataformas de transparencia del gobierno de Chile, y en concreto de la Municipalidad de Palmilla, cuál era la licencia que utilizaba la página web de esta última. La respuesta que me llegó el día de hoy me señala que se trata de una "licencia de software libre estándar W3C Software Notice and Licence", que es la que señalé en el archivo que subí (Template:W3C Licence). Entiendo que usted desconocía esa información, pero por lo menos me pudo haber señalado mi error en mi página de discusión y así yo le hubiera aclarado la situación.

Respecto del resto de los archivos que borró, asumo que se trata de una situación similar (uso incorrecto de licencias). Nuevamente me hubiera gustado un aviso previo, sin embargo, comprendo que sólo aplicaba las normas sobre uso de licencias en Wikimedia. Intentaré conocer cuáles son las licencias que corresponde usar para dichas imágenes, solicitando dicha información por transparencia a los gobiernos regionales de Chile. Le recuerdo también que uno de esos archivos era un cropped de File:Ricardo Diaz foto.jpg, y no entiendo por qué borró mi recorte y no el original.

Escudos y banderas de subdivisiones del Ecuador[edit]

Buenas noches

Veo que está en la labor de borrar escudos y banderas ecuatorianas con la justificación de que están sujetas a copyright, ¿me podría alcanzar la codificación legal de dicha norma? no encuentro nada respecto a símbolos municipales.

También tengo otra duda, ¿esto significa que va a borrar TODAS las banderas y escudos de ciudades y cantones ecuatorianos, e incluso hasta los nacionales?

Estimado @Milenioscuro. La ley ecuatoriana de propiedad intelectual no hace una excepción expresa a las obras de arte generadas por empleados públicos u órganos de la administración en el cometido de sus funciones, haciendo solo referencia a documentos. Esto no significa que los escudos, banderas, etc. no puedan ser de dominio público por otros motivos, por ejemplo, por antigüedad o porque el diseño haya sido incorporado en el documento que lo reglamenta, como en un decreto que apruebe el uso de tales símbolos. He visto un par de casos así y me he preocupado de no borrarlos. Por cierto que los archivos borrados pueden ser restaurados en la eventualidad de que se encuentre tal documento que acreditaría que la obra de arte, como dije no exenta de protección expresamente, esté en dominio público. Debo agregar también que este borrado se produce como consecuencia del abuso de largo plazo cometido por David C. S., quien subió una infinidad de escudos y banderas para las cuales no tenía derechos y las ponía como "obra propia". Se dió el caso igualmente de que existían banderas que son suficientemente simples a las que incorporaba el escudo. Hubo que revisar manualmente todas sus subidas y realizar las reversiones correspondientes. Ha sido un trabajo largo, como puedes imaginar. El problema del "trabajo propio" es un mal general, sin embargo, en los archivos que he revisado de los emblemas ecuatorianos. Si puedes ayudar corrigiendolos y pidiendo el borrado de los que no cuenten con permiso para alojarse en Commons, lo agradecería. La cuestión es que no soy ecuatoriano, solo subí un escudo (el de la provincia de Chimborazo) solo porque este se encontraba disponible en un archivo anteriormente subido que era la bandera, desconozco completamente la legislación ecuatoriana respecto a lo que es de licencia libre o no. Mi situación es más particular: he realizado en formato svg numerosos escudos y banderas para ilustrar los artículos de Colombia y sus subdivisiones, la cuestión es que los gobiernos de esas entidades (incluido el nacional) han tomado dichos emblemas y los han puesto en sus propias páginas como si fueran creaciones suyas, poniéndole unos derechos de autor que no tienen ni deberían tener, pues fueron subidas a commons con licencia de compartir y dar atribución. Si se llegara el caso de revisar esas subidas, ahí si pondría yo rotunda objeción, pues tengo como probar que son archivos originales míos.

Revisando COM:Colombia "In all cases where a work has as its owner a legal entity or an official body or any institution under government public law, the term of protection shall be deemed to be 70 years as from the date of publication." O sea, solo los escudos y emblemas que hayan sido publicados en 1953 o antes están en el dominio público. Te recomiendo que seas tu mismo quien etiquete para borrado aquellos que no cumplan con ese precepto. No, porque yo creé esos escudos y banderas de acuerdo a las descripciones dadas por las diferentes legislaciones que se encontraba en sus páginas oficiales, ellos pueden tener derechos sobre SU PROPIA VERSIÓN del dibujo, pero no sobre la mía. Por ejemplo, en commons tenemos Template:Coa blazon que nos permite subir una versión de un emblema siempre y cuando se siga la ley heráldica y se cumpla con la legislación que creó el blasón, sin romper con ello derechos de autor, a no ser que la ley diga explícitamente que ninguna versión del emblema puede usarse para algo que no sea de carácter oficial. Borrado injustificado[edit]

Buenos días, veo que haz borrado cantidad de fotos y dibujos de mi autoría sin justificación alguna y de manera equivocada. Me imagino que el problema tal vez se originó a partir del borrado de banderas y escudos del Ecuador, pero por alguna razón también se borraron otras imágenes no relacionadas con esta discusión incluyendo gran cantidad de dibujos cuyos originales todavía conservo. En mi página de discusión está la lista de todo lo que se borró injustificadamente.

@SimonLuzuriaga: Te he señalado que el motivo para mantener borradas las fotografías ha sido que no cuentan con datos EXIF. File:Montañas de Curipogrio.jpg solo dice "Software used: Google". File:Decapitadores de la Tolita.jpg no tiene ningún dato. File:Disco de cobre del Museo Weilbauer.jpg tampoco, así como File:Mascara Tolita de oro y platino 2.jpg y File:Maquetas Tolita.jpg. Las he restaurado para chequear precisamente que no contaban con EXIF y así fue. @Bedivere He subido los archivos originales para estas imágnes expeto para File:Maquetas Tolita.jpg, ya que este último archivo se trata de una imágen editada en la cual he juntado varais imágenes orginales mías, por lo cual no existe un solo archivo original, como podría demostrar que soy el autor en este caso, si quieres podría buscar las trés imágnes originales y subirlas idnependientemente. Por otro lado, como podras observar, todos estas imágnes han sido editadas ligeramente para reencuadrar la foto o para eliminar el fondo, y pienso que estas es la razón pro la que no contaban con EXIF. Buenos días @Bedivere nuevamente, escribo de nuevo para hacerte acuerdo que hay varios archivos eliminados injustificadamente que no han sido restaurados, he propuesto maneras de demostrar que los archivos son trabajos originales míos aunque no he recibido respuesta. Recuperar estos archivos es espcialmente importante para mi porque se tratan de ilustraciones inicialmente hechas en papel pero terminadas digitalmente, y si bien concervo los dibujos en papel, no conservo las versiones digitales en mi computadora, motivo por el cual, mientras no hallan sido restaradas, prácticamente he perdido todo acceso a mis ilusraciones.

Por este motivo pido nuevamente que se restauren los archivos faltantes, y nuevmanete propongo; si todavía tienes dudas de la originalidad de estos archivos, podría subir fotos de los dibujos originales para demotrar que yo soy el autor. Sin embargo, si no recibo respuesta tendré que solicitar la intervención de otros usuarios.

"Puntas idealizadas del sitio arqueológico El Inga, Ecuador, inpiradas por las publicaciones de Robert Bell " Archaeological Investigation at the Site of EI Inga, Ecuador" (2000) y William Mayer-Oakes' "El Inga Projectile Points-Surface Collections" (1966)."

Preocupación por borrados[edit]

Hola Bedivere, me encuentro preocupado por lo que parece ser algunos borrados injustificados que has realizado, como menciona el usuario SimonLuzuriaga arriba. Soy parte del grupo de usuarios Wikimedistas de Ecuador y es claro que hay un problema cuando uno de nuestros integrantes que es un usuario que estudia un postdoctorado de arqueología y que ha subido a lo largo de los años dibujos realizados por él mismo de la historia arqueológica y la cultura de civilizaciones ecuatorianas precolombinas para ilustrar artículos en Wikipedia, así como fotos tomadas por él mismo de estos objetos históricos, nos comenta que han sido borradas sus aportaciones de forma extensa desde ayer (no en referencia a los escudos, sino a los dibujos y fotos de las culturas precolombinas). Me preocupa en sobremanera esto porque en los borrados masivos podrian haber otros casos como el suyo con usuarios que tal vez no se han enterado aún, dado que la mayoría de estos archivos no tuvo el anuncio correspondiente a los usuarios antes del borrado. Tambien me llama la atención el pedido de metadata en fotos. No recuerdo que haya una regla en Commons sobre obligatoriedad de metadata en una foto para ser subida. Si es que la hay, podrias indicarme El link de donde esté? Mas tomando en cuenta que la metadata puede facilmente desaparecer al crear una versión Nueva de una foto en editores como Gimp, muy usados por la comunidad al ser open source. @Freddy eduardo El caso de Simón es particular, ya que solo sus contribuciones junto con las de David C. S. fueron las que revisé ayer en extenso. Es cierto que se me pasaron algunos archivos que revisados más detenidamente, eran de su propio trabajo. Pero hay otros que parecen escaneos de obras impresas, o fotografías sin datos EXIF, que no me permiten concluir que verdaderamente sean suyas. Puede pedir su restauración en el tablón que corresponde. Me disculpo con Simón por el borrado erróneo de algunos de sus archivos. Con respecto a la segunda parte de tu comentario, "Me preocupa en sobremanera esto porque en los borrados masivos(...)", puedo asegurarle que se trata exclusivamente de obras con derechos de autor vigentes y que no pertenecen a los usuarios que las subieron. Los logotipos en su mayoría son complejos y no son tan pequeños como es otro caso que consultaste ahora, por lo que creo que debería eliminarse. Además, tengo la duda de si las fotografías son obra de empleados públicos, me parece que no, especialmente en el caso de aquellos partidos opositores. Como te he señalado, si es posible presumir que fue generada por un empleado público, está en el dominio público. No tengas tantas dudas al subir imágenes.
