Licencia en archivos alojados en el Archivo General de la Nación | AGN[edit]

Buenas noches, he estado revisando sus subidas en Wikimedia Commons, en cuanto a archivos alojados en el Archivo General de la Nación de la República Dominicana. Usted está etiquetando todo con licencia Creative Commons Zero 1.0, pero revisando el sitio web del archivo, no hay nada que indique que lo alojado tiene esa licencia.

Es posible que usted inconscientemente esté subiendo archivos con licencia no compatible para Wikimedia Commons. En ese sentido, me dirijo a usted para que me aclare y me indique si en efecto tienen la licencia CC0 1.0 o sino en los próximos días me veré obligado a someter a consulta de borrado a todos los aportes hechos provenientes de dicho archivo. Tenga en cuenta que Wikimedia Commons no es un sitio de hosting, y sólo acepta imágenes con licenciamiento libre (por ejemplo, dominio público o Creative Commons con licencias libres). Buenas nuevamente, he notado que en la noche de ayer realizó algunas acciones, pero no me contestó a este mensaje. En ese sentido, dado su silencio, procederé a realizar la consulta de borrado debido a la imposibilidad de justificar la licencia de todos esos archivos subidos. Saludos, no había notado el mensaje hasta hoy. Del Archivo General de la Nación de la República Dominicana he subido en su mayoría fotos seguras de no contener derechos de autor [el derecho de autor se puso vigente en la República Dominicana en julio de 1986]. Gracias por su pronta respuesta. Permítame aclarar en su contestación, ¿estos archivos siguen la normativa de dominio público de dicho país o siguen una licencia CC0 1.0? Tenga en cuenta que las normas de derechos de autor por lo general pueden ser retroactivas (depende de la legislación de cada país), por ende pueden haber obras con derechos de autor anteriores a julio de 1986. Favor revise la Ley 65-00 del año 2000, Título III para clarificar la situación con los archivos que subió, existe un porcentaje que no se ajustan a lo que expone. Además, no es comprensible que todas usen la plantilla {{CC0}} y no la de {{PD-Dominican Republic}}; la licencia CC0 tiene una especificación totalmente distinta que la de dominio público. Una vez aclarado todo eso podré proceder de mejor manera, temo que no cambia el hecho de exponer todas las subidas a una próxima consulta de borrado y verificar todo lo subido. Saludos. El uso de la plantilla {{CC0}} se debe a que al subir las imágenes se me permite esa única opción y según he leído en creative commons no está mal usarla. Cuando se trata de los derechos de autor, la ley dice que un trabajo anónimo que se publicó por primera vez hace más de 50 años ya no tiene derechos de autor a menos que sea reclamado. En el caso de fotografías de funcionarios públicos, los derechos pasan a la organización donde se encontraba dicha persona.

Un consejo importantísimo, cuando suba las imágenes debe estar siempre atento a la licencia que va a asignar, en el momento de la subida le aparecen varias opciones predeterminadas, pero si dentro de ellas no está la licencia libre específica debe añadirla manualmente. Lo que pasa es que como le dije {{CC0}} ≠ {{PD-Dominican Republic}}, y por eso sí toca hacer las correcciones. No puedo borrar directamente los archivos ya que no soy administrador en Commons, lo más que puedo hacer es hacer una consulta de borrado y que sea evaluado por un administrador.
