[edit]Gracias por su colaboración en la subida de archivos a Wikimedia Commons. Le recordamos que todos los archivos que usted suba o transfiera de Wikipedia en inglés deben de ser categorizados, para que otros usuarios puedan localizarlos con facilidad. Estas categorías deben de ser lo más específicas posibles. Es decir, si usted sube una foto de un cráter de luna no debe de ir a la categoría genérica de «Cŕateres de la Luna» sino debe buscar las categorías específicas a la que pertenece ese cráter, que en este caso sería buscar la categoría que tenga el nombre de dicho cráter.
Así mismo cuando cree un artículo en Wikipedia debe de colocar un enlace hacia Commons si éste tiene una categoría que corresponda con el artículo creado. El enlace se debe de colocar en la sección «Enlaces externos» con el formato {{commonscat|categoría commons}}. Si tiene alguna duda me puede preguntar. - Como se indica en vuestra amable nota, las fotografías cumplen las condiciones siguientes:
- Todas las fotografías pueden ser datadas (con razonable certeza) como máximo en la década de 1930, por lo que han pasado más de 70 años desde su realización.
- Su autor es desconocido (o al menos, el nombre del autor no consta en el lugar de donde se han obtenido las fotografías, ni es fácilmente accesible a priori).
- Respecto a las citadas fotografías afectadas por haber sido consideradas en el dominio público bajo la condición {{PdOld}}, considero adecuada la observación realizada con respecto a la incoherencia de la fecha de fallecimiento del autor.
- En consecuencia, se va a reconsiderar el etiquetado de estas fotografías, atendiendo a las circunstancias siguientes:
- Algunas de ellas, cuentan con evidencias razonables de que han sido publicadas a principios del siglo XX (por ejemplo, File:Peary dogs.jpg procede de una tarjeta postal sin fechar, pero que por su aspecto es razonable pensar que procede de esta época (véase: Peary Post Card). En consecuencia, podría ser considerada como {{Pd-US}}
- En el caso de la fotografía File:Emil Jellinek.jpg, es exactamente la misma fotografía (con algo más de calidad) que ya figura en commons File:Wimbit-Jellinek-Main.jpg licenciada bajo la atribución Creative Commons Attribution-Share Alike 3.0.
- En la mayoría de los casos restantes, no hay constancia explícita ni indirecta de cuándo fueron publicadas, pero su presencia en internet es una evidencia de que han sido publicadas con anterioridad en algún momento (por ejemplo, File:Walter Owen Bentley.jpg debió realizarse con fines informativos o publicitarios, y es razonable pensar que fue publicada cuando se realizó, en 1924). Al estar realizada la fotografía en Francia, puede ajustarse a {{PD-France}}.
- La Convención de Berna fija con carácter genérico un plazo de vigencia de los derechos de 50 años desde la fecha de publicación para obras de autor desconocido. En consecuencia, a falta de un dato más exacto, parece razonable pensar que las fotografías pudieron ser publicadas por primera vez aproximadamente cuando se tomaron (de hecho, como se ha señalado anteriormente, la presencia en internet de estas fotografías tan antiguas indica que ya han sido publicadas alguna vez con anterioridad en algún tipo de documento).
- Otro aspecto importante es el del "carácter artístico" (objeto de la Convención de Berna) de las fotografías. Este carácter es obvio en el caso de fotógrafos reconocidos (obras "firmadas", o realizadas con intención artística). Pero fotografías meramente funcionales o informativas (como las fotografías de carnet, cuya única función es identificar a un individuo), es cuestionable que sean consideradas como "artistic works", y por lo tanto, es más que dudoso que sean objeto de derechos de autor.
- Al ser "obras huérfanas" (sin autor conocido ni fecha de publicación conocida) considero que lo más correcto es encuadrarlas en el dominio público de los países donde hayan sido tomadas ({{Pd-Coutry}}), dado que en todos los casos han pasado más de 70 años desde su fecha más probable de publicación.
- En fin, entiendo la preocupación de los responsables de Wikipedia por la protección de los derechos de autor, pero considero que estas "fotografías huérfanas" reúnen las condiciones necesarias para ser consideradas como parte del dominio público (y de facto, ya forman parte del citado dominio público a través de su difusión pública sin limitaciones en internet).
