The official position taken by the Wikimedia Foundation is that "faithful reproductions of two-dimensional public domain works of art are public domain, and that claims to the contrary represent an assault on the very concept of a public domain". For details, see Commons:When to use the PD-Art tag. {{PD-Art}} template without parameter: please specify why the underlying work is public domain in both the source country and the United States
(Usage: {{PD-Art|1=|deathyear=|country=|date=}}, where parameter #1 can be PD-old-auto, PD-old-auto-1923, PD-old-100 or similar) |
||||
This image is in the public domain because it is a mere mechanical scan or photocopy of a public domain original, or – from the available evidence – is so similar to such a scan or photocopy that no copyright protection can be expected to arise. The original itself is in public domain for the following reason:
This tag is designed for use where there may be a need to assert that any enhancements (eg brightness, contrast, colour-matching, sharpening) are in themselves insufficiently creative to generate a new copyright. It can be used where it is unknown whether any enhancements have been made, as well as when the enhancements are clear but insufficient. For known raw unenhanced scans you can use an appropriate {{PD-old}} tag instead. For usage, see Commons:When to use the PD-scan tag. |

Denmark[edit]
| This image is in the public domain because the Danish Author's rights legislation of 2008 specifies that all photographic "works of art" become public domain 70 years after the death of the photographer.
Note that photographs which are not considered to be works of art become Public Domain 50 years after their creation (§70, 2). See Licensing for details. This template is for works with a known author. For anonymous works, see {{Anonymous-EU}}. English | македонски | +/− |
|
| This image is in the public domain because the Danish Consolidated Act on Copyright of 2010 specifies (§91, 5) that all photographic images not considered to be "photographic works" that were created before 1 January 1970 are exempt from protection.
Note that "photographic works", which must display artistic merit or originality, enter the public domain 70 years after the death of the photographer and that photographs that are not considered works but created 1 January 1970 or later become public domain 50 years after they were created. See Licensing for details. Some countries have a lower threshold of originality and may therefore apply a longer protection term for this image, so it may not be usable in such countries. To uploader: For this to be applicable, creation year must be known (or known to be at least before 1970)
Note: in addition to this statement, there must be a statement on this page explaining why the photograph is public domain in the United States.

Finland[edit]
| This image is in the public domain because the Finnish Copyright law of 2005 specifies that all ”works of art” become public domain 70 years after the death of the creator, or 70 years after the date of publication if the works are anonymous and the author did not become known before 70 years from publication had gone.
Note: Photographs which are not considered to be works of art and are created before January 1, 1966 are in the public domain (§49a). See {{PD-Finland50}} for details. This template claims only that the image is public domain in Finland. An additional template should be included to explain why the image is public domain in the United States. |
|
| This photograph is in the public domain, because either 50 years has elapsed from the year of creation or the photograph was first published before 1966. The §49a of the Finnish copyright law of 2005 specifies that photographs not considered to be "works of art" become public domain 50 years after they were created. The 50 years from creation protection period came into force in 1991. Before that the protection period was 25 years from the year of first publication according to the §16 of the law of protection of photographs of 1961. Material already released to public domain according to the 1961 law remains in public domain, and therefore all photographs (but not photographic works of art) released before 1966 are in the public domain. See Commons:Copyright_rules_by_territory#Finland for details. If you think this picture should be considered a work of art, add {{Delete-PD-Finland50}} to this page.

| This postage stamp published by Posti- ja telelaitos before January 1, 1990 is in the public domain because it is a part of a decision issued by a public authority in Finland. Section 9 of the Finnish Copyright Act specifies that no copyright exists in such material. (Link to the Act) This template does not apply to postage stamps first published after 1989. Because Posti- ja telelaitos was changed from an authority to a company in the beginning of 1990, postage stamps published by Posti- ja telelaitos were not anymore part of decisions by an authority. Most probably the copyright owner of postage stamps published after 1989 are Itella Oyj or the designer of them. Switzerland[edit]
|
This photograph was first published in Switzerland. It does not have the individual character required for copyright protection under Art. 2 par. 1 of the Swiss Copyright Act. See Wikipedia for details. According to applicable case law, the individual expression of thought required for protection is present if the photograph is given an individual character e.g. by the choice of framing, the use of camera settings or the editing of the image. Conversely, it is not present, irrespective of the object and the setting, if the image is a mere "point-and-click" image with no individual characteristics. See Blau Guggenheim v. British Broadcasting Corporation BBC, BGE 130 (2004) III S. 714-720. Vgl. Blau Guggenheim gegen British Broadcasting Corporation BBC, BGE 130 (2004) III S. 714-720, m. w. Nw. |
